It is the intent of the City Council, for purposes of promoting the local economy, tourism and for further purposes of beautifying the city, to adopt standards regulating murals, their location and design.
(A) Location. Murals shall be located on the sides of buildings and walls within TIP area B and any other commercially or industrially zoned property within the City of Tulare.
(B) Mural design approval. Prior to painting, installation and execution of a mural, an application shall be submitted to the Planning and Building Department. The application shall include a detailed drawing or sketch of the mural plus other details as prescribed on the application or deemed by Planning and Building Department staff to be pertinent. The Planning and Building Department shall forward the application, with a recommendation, Redevelopment Director, Planning and Building Director, and Tulare Improvement Program (TIP) Coordinator, hereinafter known as the Mural Committee (MRC). The MRC shall review and approve or deny the application as submitted, or approve the submitted application subject to modifications.
(C) Mural design amendment.
(1) Prior to amending an approved mural design (whether painted or not painted), that has been approved by the MRC an application for an amendment shall include a detailed drawing or sketch of the mural, plus other details as prescribed on the application or deemed by Planning and Building Department staff to be pertinent.
(2) The Planning and Building Department shall forward the application, with a recommendation, to the MRC. The MRC shall review and approve or deny the application as submitted or approve the submitted application, subject to modifications.
(D) Criteria for design of murals. The following criteria shall apply to the design of murals submitted for approval:
(1) The subject matter shall be of historical significance regarding the growth and development of the City of Tulare and its surrounding environs or be of such high quality as to be appropriate.
(2) The paint to be used shall be appropriate for use in an outdoor locale, for an artistic rendition and shall be of a permanent, long-lasting variety.
(3) The mural shall be designed and painted by qualified mural artists with sufficient knowledge in the design and painting of such projects and the application of paints for such projects.
(4) To the extent feasible, the mural shall be vandal and graffiti resistant.
(E) Mural Review Committee (MRC). Approval of a mural design shall occur only after public notice is posted at City Hall and an opportunity is provided to any interested party to present any appropriate comments, considerations and/or concerns, either in writing or orally, to the MRC.
(F) Appeals to the City Council. Any interested party may appeal a decision of the MRC regarding a mural application. The appeal must be in writing and must be received by the Planning and Building Department within five days of the action by the MRC. The appeal shall be considered by the City Council, following a notice posted at City Hall and a hearing before the City Council. Action of the City Council shall be considered final.
(G) Enforcement—Penalties. Violation of this chapter shall constitute a misdemeanor punishable by a fine of not more than $500 or by imprisonment in the Tulare County Jail not to exceed six months, or by both such fine and imprisonment.
