ORDINANCE NO. 8509
Relating to Planning and Zoning; Adopting the Land Use Code, Chapter 23, Which Shall Become Effective On July 1, 1995. 
WHEREAS, the City of Tucson acting through public hearings, citizen participation and in conjunction with the Citizens Advisory Planning Committee (CAPC), the Zoning Code Revision Subcommittee and City staff have conducted a complete review, amendment and recodification of the Tucson Zoning Code over a period of several years to create the Land Use Code (LUC) which is effective as of July 1, 1995; and
WHEREAS, the implementation of that review, amendment and recodification has occurred in phase segments which have been adopted by the mayor and council over several months; and
WHEREAS, it is desirable to provide for the passage of the LUC in a single ordinance to establish the relationship of the Land Use Code to the Zoning Code and to provide for a single date of enactment;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF TUCSON, ARIZONA, AS FOLLOWS:
Section 1. Ordinance No. 8299 which was duly adopted on June 13, 1994 and which established the Office and Commercial Zones and related development regulations under the LUC is incorporated herein by reference.
Section 2. Ordinance No. 8409 which was duly adopted on November 28, 1994, and which amended the effective date of the LUC Office and Commercial Zones from January 1, 1995, to July 1, 1995 is hereby incorporated by reference.
Section 3. Ordinance No. 8443 which was duly adopted on February 6, 1995 and which established Motor Vehicle and Bicycle Parking Regulations, Subdivision Regulations, Landscaping and Screening Regulations, and the Overlay Zones, including Hillside Development zone (HDZ), Scenic Corridor Zone (SZC), Major Streets and Routes (MS&R) Setback Zone, Gateway Corridor Zone, Airport Environs Zone (AEZ), Environmental Resource Zone (ERZ), and Downtown Heritage Incentive Zone and related use and development regulations under the LUC is hereby incorporated by reference.
Section 4. Ordinance No. 8484 which was duly adopted on April 10, 1995 and which established the administration provisions of the LUC and related development and use regulations and amended certain portions of the previous enactments under the LUC is hereby incorporated by reference.
Section 5. Ordinance No. 8497 which was duly adopted on May 8, 1995 and which established Residential and Industrial Zones, the Specific Plan Zone, and the Multiple Use Zone and related development and use regulations under the LUC and which amended certain provisions of the LUC which had been previously adopted is incorporated by reference.
Section 6. Ordinance No. 8498 which was duly adopted on May 8, 1995, and which established the rules for the transition from the Zoning Code to the LUC is incorporated herein by reference.
Section 7. Ordinance No. 8499 which was duly adopted on May 8, 1995 and which established the Rural Village Center Zone (RVC) and related development and use regulations is incorporated herein by reference.
Section 8. Ordinance No. 8501 which was duly adopted on May 15, 1995 and which established the Historic Preservation Zone under the LUC is incorporated herein by reference.
Section 9. Ordinance No. 8505 which was duly adopted on May 22, 1995 and which established the use and development regulations governing large bars and dance halls is incorporated herein by reference.
Section 10. Ordinance No. 8508 which was duly adopted on May 22, 1995 and which established the Off-Street Loading Requirements, added and amended definitions, and reconciled various provisions and use and related development regulations within the LUC is incorporated herein by reference.
Section 11. The adoption of this Land Use Code supercedes all prior provisions of Chapter 23, Tucson Zoning Code, as of July 1, 1995. Subject to the transition provisions established in Ordinance No. 8498 all provisions of the Tucson Zoning Code, Chapter 23, effective prior to July 1, 1995, shall cease to have any effect as of July 1, 1995, except such effect as may be necessary for the interpretation or application of other ordinances, resolutions, agreements or other legal documents which are in effect as of July 1, 1995.
Section 12. In the event that any provision or section of the Land Use Code is declared to be invalid for any reason, the prior comparable provisions of Chapter 23, the Tucson Zoning Code shall be in effect in place of any such invalid provision as those such sections had not been repealed and to the extent that any such provisions are consistent with all portions of the LUC which remain in effect.
Section 13. The various city officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance.
Section 14. Three copies of the Land Use Code shall be filed with the City Clerk's Office and maintained as public records of the City of Tucson. The Land Use Code shall be published separately from the Tucson Code.
Section 15. Whereas, it is necessary for the preservation of the peace, health and safety of the City of Tucson that this ordinance become immediately effective, an emergency is hereby declared to exist, and this ordinance shall be effective immediately upon its passage and adoption.
