141.32 EDUCATIONAL INCENTIVE PLAN FOR POSITIONS OF POLICE CHIEF, FIRE CHIEF, AND ASSISTANT FIRE CHIEF.
   This provision shall apply to incumbents in the position of Police Chief, Fire Chief, or Assistant Fire Chief as of January 1, 2013, and such incumbent Assistant Fire Chief that may later be appointed Fire Chief. Other persons appointed to the position of Police Chief, Fire Chief, or Assistant Fire Chief after January 1, 2013, may only receive an Educational Incentive Plan under the provision of Section 141.31.
   A Police Chief, Fire Chief or Assistant Fire Chief who is an incumbent in such position as of January 1, 2013, and who reaches steps 4 or 5 will not also receive benefits under Section 141.31, Educational Incentive Plan for positions exempt from the provisions of FLSA.
   In keeping with the City's policy of encouraging the professional improvement of the police and fire personnel, the City shall provide an Educational Incentive Plan for the Fire Chief, Assistant Fire Chiefs, and the Police Chief. In addition to the authorized pay range for the Fire Chief, Assistant Fire Chief, and Police Chief, those positions shall be eligible for Educational Incentive Pay in accordance with the following rules, regulations and schedule, an amount as set forth below:

   All degrees shall be earned from an accredited institution of higher learning as approved by the Director of Public Service and Safety. The degree must be in fire science, fire technology, fire engineer, public administration, business administration, an associate degree in paramedic, or other similar degree as approved by the Director of Public Service and Safety.
    E.I.P. payments shall be made annually and shall be paid in December of each year and shall be paid on or before December 15, and are to be annually listed on the payroll. If a Chief or Assistant Chief leaves the employment of the City of Troy prior to December 1, no E.I.P payment shall be made.
   A Chief/Assistant Chief may seek reimbursement of tuition expenses under Section 141.30 (formerly Section 141.28) of the Codified Ordinances of the City of Troy and Administrative Regulation SD-4-95, Tuition Reimbursement Policy for classes to earn the above referenced degrees; however, a Chief/Assistant Chief may not receive Tuition Reimbursement Policy and E.I.P. benefits in the same calendar year. The rules and requirements contained in Administrative Regulation SD-4-95 shall be fully applicable to any employee seeking tuition reimbursement under this section. Approval of tuition reimbursement shall be subject to budgetary constraints and restrictions.
   The City will pay the registration or enrollment fees for the 48 hour paramedic refresher course for the Fire Chief/Assistant Fire Chiefs. A Fire Chief/Assistant Chief attending the course shall do so on his own non-working time.
