§ 70.60 NUISANCE DECLARED.
   (A)   Any motor vehicle used in connection with the following shall be declared a public nuisance and subject to seizure and impoundment under this subchapter:
      (1)   A violation of ILCS Ch. 625, Act 5, § 6-101, operating a motor vehicle with an expired license, permit, or a restricted driving permit if the period of expiration is greater than one year, or operating a motor vehicle without ever having been issued a driver’s license or permit; ILCS Ch. 625, Act 5, § 6-303, driving while driver’s license, permit or privilege to operate a motor vehicle is suspended or revoked, except a person whose driver’s license, permit or privilege to operate a motor vehicle is suspended only for an unpaid citation (parking or moving) or a violation of ILCS Ch. 625, Act 5, §§ 13 et seq., the Emissions Inspection Law; a violation of ILCS Ch. 625, Act 5, § 11-204, fleeing or attempting to elude a peace officer; ILCS Ch. 625, Act 5, § 11-204.1, aggravated fleeing or attempting to elude a peace officer; ILCS Ch. 625, Act 5, § 11-401, motor vehicle accident involving death or personal injuries; ILCS Ch. 625, Act 5, § 11-402, motor vehicle accident involving damage to vehicle; ILCS Ch. 625, Act 5, § 11-403, duty to give information and render aid; ILCS Ch. 625, Act 5, § 11-404, duty upon damaging unattended vehicle or other property; ILCS Ch. 625, Act 5, § 11-501, driving under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof; ILCS Ch. 625, Act 5, § 11-503, reckless driving or aggravated reckless driving; ILCS Ch. 625, Act 5, § 11-506, street racing, aggravated street racing or ILCS Ch. 625, Act 5, § 11-601.5, driving 40 miles an hour or more in excess of the applicable limit of the vehicle code, or against whom a warrant has been issued by a Circuit Court for failing to appear to answer charges that the person was:
         (a)   Operating a motor vehicle with an expired driver’s license (ILCS Ch. 625, Act 5, § 6-101);
         (b)   Operating a motor vehicle while that person’s license was suspended or revoked (ILCS Ch. 625, Act 5, § 6-303); or
         (c)   Operating a motor vehicle while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof (ILCS Ch. 625, Act 5, § 11-501);
      (2)   A violation of ILCS Ch. 720, Act 5, § 11-6, indecent solicitation of a child; ILCS Ch. 720, Act 5, § 11-26, traveling to meet a minor; ILCS Ch. 720, Act 5, § 12-2, aggravated assault; ILCS Ch. 720, Act 5, § 12-4, aggravated battery; ILCS Ch. 720, Act 5, § 12-4.2, aggravated battery with a firearm; ILCS Ch. 720, Act 5, § 12-4.3, aggravated battery of a child; ILCS Ch. 720, Act 5, § 12-4.6, aggravated battery of a senior citizen; ILCS Ch. 720, Act 5, § 12-7.3, stalking; ILCS Ch. 720, Act 5, § 16A-3, retail theft, when the value of the merchandise exceeds $150; ILCS Ch. 720, Act 5, § 18-1, robbery; ILCS Ch. 720, Act 5, § 18-2, armed robbery; ILCS Ch. 720, Act 5, § 19-1, burglary; ILCS Ch. 720, Act 5, § 19-3, residential burglary; ILCS Ch. 720, Act 5, § 20-1, arson; ILCS Ch. 720, Act 5, § 20-1.1, aggravated arson; ILCS Ch. 720, Act 5, § 20-2, possession of explosives or explosive or incendiary devices; ILCS Ch. 720, Act 5, § 21-1, criminal damage to property; or ILCS Ch. 720, Act 5, § 25-1(a)(1) or ILCS Ch. 720, Act 5, § 25-1(d), mob action; of the Illinois Criminal Code;
      (3)   A violation of ILCS Ch. 720, Act 570, § 401, manufacture of controlled or counterfeit substance or controlled substance analog prohibited; ILCS Ch. 720, Act 570, § 401.1, controlled substance trafficking; or ILCS Ch. 720, Act 570, § 402(a), (b), or (c), possession of controlled or counterfeit substance, of the Controlled Substances Act;
      (4)   A violation of ILCS Ch. 720, Act 550, § 4, possession of more than ten grams of any substance containing cannabis; ILCS Ch. 720, Act 550, § 5, manufacture, delivery, or possession with intent to deliver or manufacture prohibited; ILCS Ch. 720, Act 550, § 5.1, cannabis trafficking; ILCS Ch. 720, Act 550, § 5.2, delivery of cannabis on school grounds; or ILCS Ch. 720, Act 550, § 8, unauthorized production or possession of cannabis sativa plant, of the Cannabis Control Act;
      (5)   A violation of ILCS Ch. 720, Act 600, § 3.5, possession of drug paraphernalia, of the Drug Paraphernalia Control Act; or
      (6)   Operation or use of a motor vehicle in the commission of, or in the attempt to commit, any other misdemeanor or felony offense in violation of the Criminal Code of 1961, when so provided by local ordinance.
   (B)   Any motor vehicle which is used in connection with the following shall also be declared a public nuisance and subject to seizure and impoundment under this article: a violation of ILCS Ch. 720, Act 5, § 24-1, unlawful use of weapons; ILCS Ch. 720, Act 5, §
