(A) Findings. The corporate authorities hereby make the following findings.
(1) The boundaries of the proposed Dorothy Drive Business District are set forth in Exhibit A attached to Ordinance 2005-23 and incorporated herein as if set out in full by this reference. The map of the proposed Dorothy Drive Business District is depicted on Exhibit B attached to Ordinance 2005-23 and incorporated herein as if set out in full by this reference.
(2) By reason of the predominance of defective or inadequate street layout, unsanitary or unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, or the existence of conditions which endanger life or property by fire or other cause, or any combination of these factors, the proposed Dorothy Drive Business District is “blighted” under the Business District Act, being ILCS Ch. 65, Act 5, § 11-74.3, and retards the provision of housing accommodations, and constitutes an economic and a social liability and a menace to the public health, safety, morals and welfare in its present condition and use.
(3) The proposed Dorothy Drive Business District on the whole has not been subject to growth and development through investment by private enterprises, and would not reasonably be anticipated to be developed or redeveloped without the adoption of the Dorothy Drive Business District Plan.
(4) The Dorothy Drive Business District Plan conforms to the Comprehensive Plan for the development of the city as a whole.
(5) As set forth in the Dorothy Drive Business District Plan and in the testimony at the hearings, the estimated date of the retirement of all obligations incurred to finance Business District project costs as defined in the Dorothy Drive Business District Plan is not later than September 19, 2028, being the date which is 23 years after the date on which this section is adopted.
(6) The parcels of real property in the proposed Dorothy Drive Business District are contiguous, and only those contiguous parcels of real property and improvements thereon which will be directly and substantially benefitted by the proposed Dorothy Drive Business District Plan are included in the proposed Dorothy Drive Business District.
(B) Plan approved; exhibits incorporated by reference. The Dorothy Drive Business District Plan which was the subject matter of the hearings is hereby adopted and approved. A copy of the Dorothy Drive Business District Plan is set forth in Exhibit C attached to Ordinance 2005-23 and incorporated herein as if set out in full by this reference.
(C) Other actions. The Mayor, the City Clerk and the proper officers, officials, agents and employees of the city are hereby authorized, empowered and directed to do all such acts and things and to execute all such documents and certificates as may be necessary to carry out and comply with the provisions of and to further the purposes and intent of this section, including the preamble to Ordinance 2005-23.
