Unless the context otherwise requires, the terms used in this chapter shall be construed according to the definitions below. Unless the context clearly requires to the contrary, in the event of a conflict between any definition in this chapter as compared to a definition in the Liquor Control Act of 1934; ILCS Ch. 235, Act 5, § 1-1, as amended, the definition in the Liquor Control Act of 1934 shall control. This chapter incorporates by reference any definition which is in the Liquor Control Act of 1934 but which is not defined in this chapter. The following definitions shall apply.
ALCOHOLIC LIQUOR. Includes alcohol, spirits, wine and beer, and every liquid or solid, patented or not, containing alcohol, spirits, wine or beer and capable of being consumed as a beverage by a human being.
BOWLING ALLEY. Any establishment or building, or any part thereof, wherein the game of bowling, played with composition balls and ten wooden pins, is played.
CATERER RETAILER. A person who serves alcoholic liquors for consumption, either on-site or off-site, whether the location is licensed or unlicensed, as an incidental part of food service. Prepared meals and alcoholic liquors are sold at a package price agreed upon under contract.
CATERING ESTABLISHMENT. Premises (other than a restaurant or club which already has a local liquor license), which are offered for lease to others for one or more events, e.g., banquets, wedding receptions or other parties, where someone other than the owner or lessor of the premises will provide food and alcoholic liquor for the event.
CLUB. A corporation organized under the laws of this state, and not for pecuniary profit, solely for the promotion of some common object other than the sale of alcoholic liquor, which conforms to the definition of a “club” in the Liquor Control Act of 1934, ILCS Ch. 235, Act 5, § 1-3.24 as presently enacted or hereafter amended.
HOTEL. Every building or other structure kept, used, maintained, advertised and held out to the public to be a place where meals are actually and regularly served and consumed and where sleeping accommodations are offered for pay to travelers and guests, whether transient, permanent or residential, in which 25 or more rooms are used for the sleeping accommodations of the guests and having one or more public dining rooms where meals are served to the guests, the sleeping accommodations and dining rooms being conducted in the same building or buildings in connection therewith, and the building or buildings, structure or structures, being provided with adequate and sanitary dining room and kitchen equipment and capacity.
LICENSEE. Any person holding a license under the provisions of this chapter.
ORIGINAL PACKAGE. Any bottle, flask, jug, can, cask, barrel, keg, hogshead or other receptacle or container whatsoever used, corked or capped, sealed and labeled by the manufacturer of alcoholic liquor, to contain and to convey any alcoholic liquor.
RESTAURANT. Any public place kept, used, maintained, advertised and held out to the public to be a place where meals are served, and where meals are actually and regularly served, without sleeping accommodations, which space being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food for its guests.
RETAIL SALE. The sale for use or consumption and not for resale.
SPECIAL EVENT. An event conducted by an educational, fraternal, political, civil, religious or nonprofit organization.
