The following words and phrases are defined for the purpose of their use in this chapter. These definitions shall apply in the interpretation and enforcement of this chapter unless otherwise specifically stated.
ADULT BOOKSTORE. A business which:
(1) Has as the principal activity the sale or rental of books, magazines, newspapers, movies, videotapes, film strips or any combination thereof which are characterized by an emphasis on portrayals and/or written descriptions of human genitals and pubic regions or an emphasis on portrayals and/or written descriptions of acts of masturbation, sexual intercourse, sodomy, analingus, bestiality, cunnilingus, coprophilia, fellatio, flagellation, frottage, urologina or similar acts; or
(2) Such a business which has a principal activity involving the sale or rental of books, magazines, newspapers, movies, videotapes, film strips or any combination thereof which are characterized by an emphasis on portrayals and/or written descriptions of human genitals and pubic regions or an emphasis on portrayals and/or written descriptions or acts of masturbation, sexual intercourse, sodomy, analingus, bestiality, cunnilingus, coprophilia, fellatio, flagellation, frottage, urologina or similar acts when that business is combined with any other adult entertainment business service or activity on the business premises.
ADULT ENTERTAINMENT BOOKING AGENCY. A business engaged in for financial remuneration, either directly or indirectly, wherein the owner, operator or agent books performances for dancers, comedians, musicians, entertainers or burlesque performers, taking a fee, commission or percentage of any money from the patron or performer for services rendered, when the performer performs in the nude or in a state of partial nudity, or engages in acts of masturbation, sexual intercourse, sodomy, analingus, bestiality, cunnilingus, coprophilia, fellatio, flagellation, frottage, urologina, combinations thereof or similar acts as part of a performance; or a similar operation.
ADULT ENTERTAINMENT BUSINESS. A business which offers one or more of the following services or activities: adult bookstore, adult theater, adult mini-theater, massage parlor, massage school, dating service, escort service, adult entertainment booking agency or similar operations.
ADULT MINI-THEATER. A business in which movies, videotapes or film strips are shown for observation by persons in individual viewing booths, when the content of the materials present is characterized by an emphasis on portrayals of masturbation, sexual intercourse, sodomy, analingus, bestiality, cunnilingus, coprophilia, fellatio, flagellation, frottage, urologina or similar acts.
ADULT THEATER. A business in which movies, videotapes, film strips, live stage shows, dancing, singing or other live performances or combinations thereof are given, when:
(1) The movies, videotapes or film strips shown are characterized by an emphasis on portrayals of masturbation, sexual intercourse, sodomy, analingus, bestiality, cunnilingus, coprophilia, fellatio, flagellation, frottage, urologina, combinations thereof or similar acts; or
(2) A live performance contains persons who perform in the nude or in a state of partial nudity, or which involves portrayals of masturbation, sexual intercourse, sodomy, analingus, bestiality, cunnilingus, coprophilia, fellatio, flagellation, frottage, urologina, combinations thereof or similar acts.
ANALINGUS. Erotic stimulation, whether actual or simulated, achieved by contact between mouth or tongue and the anus.
AUDIENCE ROOM. The portion of any adult theater in which movies or videotapes are actually shown, or stage shows, dancing, singing or other performances or combinations thereof are given.
BESTIALITY. Sexual contact of any variety, whether actual or simulated, between a human and an animal.
COMMUNITY IMPACT STATEMENT. A statement required of any adult entertainment business required to be submitted in conjunction with an application for a license to operate any business within the definition of an adult entertainment business, for consideration by the City Council in determining whether or not to license the adult entertainment business.
COPROPHILIA. The use of feces for sexual arousal or gratification, whether actual or simulated.
CUNNILINGUS. Erotic stimulation, whether actual or simulated, of the vulva or clitoris with the lips or tongue.
DATING SERVICE. A business engaged in for financial remuneration, either directly or indirectly, where the operator arranges to match a person of the same or opposite sex to a patron or patrons, for social or entertainment purposes, either on or off the premises of the dating services; or a similar operation.
ESCORT SERVICE. A business engaged in for financial remuneration, either directly or indirectly, where a person arranges for the companionship of the same or opposite sex for a patron or patrons for social or entertainment purposes, either on or off the premises of the escort service; or a similar operation.
FELLATIO. The practice of obtaining sexual arousal or gratification, whether actual or simulated, by stimulation of the penis with the mouth and/or tongue.
FLAGELLATION. An act or instance of obtaining sexual arousal or gratification by beating, flogging or scourging another or being the recipient of the action, whether actual or simulated.
FROTTAGE. Masturbation by rubbing against another person.
LICENSE. An official permit from the city to allow an activity or activities as may be required by this chapter.
MASSAGE. The performance of manipulative exercises upon the human body of another by rubbing, kneading, stroking or tapping with the hand or hands, or with any mechanical or bathing device, with or without supplementary aids.
MASSAGE PARLOR. Any place or establishment where massage is made available.
MASSAGE SCHOOL. Any place or establishment or facility which provides instruction in the theory, method and practice of massage.
MASTURBATION. Erotic activity, whether actual or simulated, involving the genital organs commonly resulting in orgasm and achieved by manual or other bodily contact exclusive of sexual intercourse or by instrumental manipulation, whether performed by the person receiving sexual arousal or gratification or by another.
NUDITY. The practice of going naked, the state of being unclothed, whether partial or total.
OPERATOR. Any person who engages in the practice of or performs a massage.
PROMOTE. To cause, permit, procure, counsel or assist.
SEXUAL INTERCOURSE. Copulation between a male and female person, either actual or simulated.
SODOMY. Penetration, whether actual or simulated, of the male organ or any instrument into the anus of another person for the purpose of sexual arousal or gratification.
UROLOGINA. Any act of sexual arousal or gratification, whether actual or simulated, associated with urine or urination.
