§ 92.056 PERMITS.
   (A)   Required. It shall be unlawful for any person to tunnel under or to make an excavation in any street, alley or other public place in the city without having first obtained a permit therefor.

   (B)   Application. Application for a permit required by this section shall be made to the City Clerk, and shall describe the location, size, purpose of the intended excavation, the name of the person doing the excavating work and the name of the person for whom the work is being done. The application shall contain an agreement that the applicant will comply with all ordinances and laws relating to the work to be done.

   (C)   Application to establish time limit for completion; extension; compliance. Each application for a permit required by this section shall state the length of time it is estimated will elapse from the commencement of the work until the restoration of the surface of the ground, or until the refill is ready for the pavement to be put on by the city if the city restores the surface pavement. It shall be unlawful to fail to comply with this time limitation unless permission for an extension of time is granted by the City Administrator.

   (D)   Fee. The fee for a permit required by this section shall be as established by the City Council.

   (E)   Bond. No permit required by this section shall be issued unless the applicant has filed with the City Clerk a bond conditioned to indemnify the city for any loss, liability or damage that may accrue from or because of the making, existence or manner of guarding or constructing any such tunnel or excavation. The bond shall have as surety a corporation licensed to do business in the state as a surety company. The bond shall be in an amount equal to the estimated cost of completing or restoring the excavation or tunnel as determined by the City Administrator.

   (F)   Issuance. No such permits shall be issued except on order of the Director of Public Works.

   (G)   Exemptions. The provisions of this section shall not apply to officers or employees of the city engaged in doing work for the city or to persons doing work for the city under contract.

   (H)   Compliance with terms of permit. It shall be unlawful to make any excavation or tunnel in any way contrary to or at variance with the terms of a permit issued pursuant to this section.
