§ 35.045 OFFICE OF THE ASSISTANT CHIEF OF POLICE CREATED.
   (A)   There is hereby established the office of the Assistant Chief of Police, who shall be appointed by the Chief of Police, by and with the consent of the Mayor and City Council. The rank of Assistant Chief of Police shall be an exempt rank immediately below that of the Chief of Police.
   (B)   The Assistant Chief of Police must possess a bachelor's degree from an accredited four-year college or university and have at least five years of full-time service as a police officer.
   (C)   The Assistant Chief of Police may be appointed from any rank of sworn, full-time officers of the Police Department. Should a suitable candidate within the Department not be identified, a qualified external candidate may be appointed. The Assistant Chief of Police shall serve at the discretion of the Chief of Police and, if an internal officer is removed from such office, shall revert to the rank previously held, without regard as to whether a vacancy exists in that rank.
   (D)   The Assistant Chief of Police shall provide those services as required by the Chief of Police. In the event there is a vacancy in the office of Chief of Police, or in the event the Chief of Police is incapacitated or otherwise not able to perform the duties of the office, the Assistant Chief of Police shall have the same powers and duties generally as that of the Chief of Police, during any vacancy in that office or during the absence or incapacity of the Chief of Police. The Assistant Chief of Police shall possess such powers and duties until such time as the vacancy in the office of Chief of Police is filled, or until such time as the Chief of Police is no longer absent or incapacitated.
   (E)   The compensation for the office of the Assistant Chief of Police shall be established from time to time by the Mayor and City Council.
