The applicant shall not be relieved of responsibility for damage to persons or property otherwise imposed by law, and the city or its officers or agents will not be made liable for the damage by:
(A) Approval of the development plan under this chapter;
(B) Compliance with conditions attached to it by the code enforcement officer;
(C) Failure of the city officials to observe or recognize hazardous or unsightly conditions;
(D) Failure of the city officials to recommend denial or to deny a development plan; or
(E) Exemptions from development plan requirements of this chapter.
