§ 156.003 EXEMPTIONS.
   Development plan approval shall not be required for the following:
   (A)   The agricultural use of land, including the implementation of conservation measures included in a farm conservation plan approved by the Soil and Water Conservation District and including the construction of agricultural structures;
   (B)   The maintenance of any existing stormwater drainage/detention component or structure or any existing soil erosion/sediment control component or structure; including dredging, tree removal or other function which maintains the original design capacities of the above; and
   (C)   The construction of, improvements to or the maintenance of any street performed by any unit of government whose powers grant that authority except as follows:
      (1)   Public road developments performed by units of government that result in less than 1.5 acres of new impervious area or less than the 1.5 acres of impervious area per linear mile shall meet the stormwater detention, water quality and buffer standards to the maximum extent practical due to the limited site conditions.
      (2)   Public road developments performed by units of government that result in more than 1.5 acres of new impervious area or more than 1.5 acres of impervious area per linear mile shall meet the standards of this section.
   (D)   The city may deny or revoke any exemption pursuant to the section at any time for any project that the municipality believes may pose a threat to the public health, safety, property, or the environment.
