§ 94.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   Any violation of § 94.01 is punishable as a Class 3 misdemeanor, as outlined in G.S. § 14-4, with a fine of not less than $50 and no more than $500. However, a violation of any provision of § 94.01 related to tobacco use shall first cause a verbal warning to the person to cease use at the park or facility. If a second violation occurs by the person or if the person continues to use tobacco, then the person shall be required to leave the park and/or facility for a duration of time to be determined by the enforcing officer. Any person ordered to vacate the premises, as required herein, and who returns prior to the time as approved by the enforcing officer or who remains on the property after having been told to vacate may be charged with trespass.
