(A) A user charge shall be levied on all users that discharge, cause, or permit the discharge of sewage into the POTW including, but not limited to, persons, firms, significant industrial users, corporations, or governmental entities.
(B) The user charge system shall take precedence over any terms or conditions of agreements or contracts which are inconsistent with the requirements of § 204(b)(1)(A) of the Clean Water Act, being 33 U.S.C. § 1284(b)(1).
(1) The user charge shall reflect, at least, the cost of debt service, operation, and maintenance (including replacement) of the POTW.
(2) Each user shall pay its proportionate cost based on volume of flow, concentration of wastewater, and percentage of maximum allowable headworks loading.
(3) The Town Manager shall review annually the sewage contributions of users, the total costs of debt service, operation, and maintenance of the POTW and will make recommendations to the Town Council for adjustments in the schedule of charges and fees as necessary.
(4) Charges for flow to the POTW not directly attributable to the users, including all extraneous flows (infiltration, inflow, and the like), shall be distributed among all users of the POTW based upon the volume of flow of the users.
