505.14 VICIOUS DOGS.
   (a)   For the purpose of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      (1)   "Unconfined" means the failure to securely confine a vicious dog indoors or confine in a securely enclosed and locked pen or structure upon the premises of the person described in subsection (b) of this section. The pen or structure must have secure sides and a secure top. If the pen or structure has no bottom secured to the sides, the sides must be imbedded in the ground no less than one foot.
      (2)   "Vicious dog" means a dog which:
         A.   Has a known propensity, tendency, or disposition to attack, unprovoked, to cause injury or to otherwise endanger the safety of human beings or other domestic animals;
         B.   Attacks a human being or another domestic animal without provocation;
         C.   Is owned or harbored primarily or in part for the purpose of dog fighting or is trained for dog fighting; or
         D.   Is recognized as a breed of dog which is customarily used for purposes of sentry guard dog or watchdog purposes to include but not to be limited by those definitions of breeds of dogs, such as German Shepherd, Doberman Pinschers, Pit Bull Terriers, and the like.
   (b)   No person owning, harboring, or having care of a vicious dog shall suffer or permit that animal to go unconfined on the premises of that person.
   (c)   No person owning, harboring, or having the care of a vicious dog shall suffer or permit that dog to go beyond the premises of that person unless the dog is securely leashed and muzzled or otherwise securely restrained.
   (d)   No person shall own or harbor any dog for the purpose of dog fighting, or train, torment, badger, bait, or use any dog for the purpose of dog fighting or for the purpose of causing or encouraging the dog to unprovoked attacks upon human beings or domestic animals.
   (e)   Subsections (b) and (c) above are necessary controls on the unrestrained activity of vicious dogs which threaten the safety of streets, parks, sidewalks, yards, and all areas of the City; and lack of knowledge or lack of intent is not a defense to a violation thereof.

   (f)   Whoever violates this section is guilty of a minor misdemeanor.
