(a) For the purpose of this chapter, “dwelling unit” means a building or portion thereof, capable of providing living facilities for one family or housekeeping unit and usually occupied for residential purposes during any portion of a given calendar quarter. Every dwelling unit shall be presumed to be occupied unless its owner submits a request for written certification of vacancy at least annually to the City Manager demonstrating that the dwelling is and will continue to be vacant. The suspension of water service or comparable circumstances which render a dwelling unit incapable of being occupied shall be a prima facie demonstration of such vacancy. Submitting a false request for certification or failing to rescind a prior certification of vacancy when a period of vacancy ends are deemed violations of this chapter and subject to the penalty specified in Section 927.99. If such request for certification of vacancy is denied, such denial may be appealed to the Utility Appeal Board in accordance with such board’s established procedures. In the case of two-family or multiple family dwellings, each unit therein shall be charged the charge mentioned below for those services.
(b) Collection and removal of garbage, rubbish and debris from dwelling units and buildings used for residential purposes shall be made at least once each week. Each dwelling unit within the Municipality shall be charged twelve dollars and sixty cents ($12.60) which is hereby authorized to be enacted for such residential service payable in advance to the Municipality. Such charge shall be collected in the same manner as water and sewer charges are collected, and in an amount as established by a resolution of Council which is hereby authorized to be enacted.
(c) City of Trotwood residents who receive refuse collection from the City of Trotwood, who have currently paid all of their refuse collection bills and who are eligible for the State of Ohio Homestead Exemption, may receive a twenty percent (20%) discount off their refuse collection bill. Residents will be required to apply for the discount with the City of Trotwood Utilities Division and provide documentation that they have qualified for and are receiving the State of Ohio Homstead Exeemption on their property.
