§ 150.01 CODES ADOPTED.
   (A)   International Building Code adopted.
      (1)   That certain document, one copy of which is on file in the office of the City Secretary, being marked and designated as the “International Building Code,” 2015 edition, including all Appendix Chapters published by the International Code Council, is hereby adopted as the building code of the city establishing the minimum regulations governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures; and each and all of the regulations, provisions, conditions and terms of such “International Building Code,” 2015 edition, published by the International Code Council, on file in the office of the City Secretary are hereby referred to and adopted as if fully set out in this section.
      (2)   Amendments. The International Building Code is amended as follows:
   Each Reference to "Jurisdiction" or location for insertion of name of jurisdiction shall mean the City of Trinidad, Texas.
   161.3.1 The areas of special flood hazard identified by the Federal Emergency Management Agency in a scientific and engineering report entitled, “The Flood Insurance Study for Trinidad, Texas” as adopted and amended from time to time with accompanying Flood Insurance Rate Maps and Flood Boundary-Floodway Maps (FIRM and FBFM) and any revisions thereto are hereby adopted by reference and declared to be a part of this ordinance.
   3409.2 Structures existing prior to November 21, 2006, in which there is work involving additions, alterations or changes of occupancy shall be made to conform to the requirements of the section or the provisions of Sections 3402 through 3406.
   (B)   International Residential Code adopted.
      (1)   That certain document, one copy of which is on file in the office of the City Secretary, being marked and designated as the “International Residential Code for One- and Two-Family Dwellings,” 2015 edition, including all Appendix Chapters, published by the International Code Council, is hereby adopted as the residential building code of the city regulating and controlling the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one- and two-family dwellings and townhouses in the City; providing for the issuance of permits and collection of fees; and each and all of the regulations, provisions, conditions and terms of such “International Residential Code for One- and Two-Family Dwellings,” 2015 edition, published by the International Code Council, on file in the office of the City Secretary are hereby referred to and adopted as if fully set out in this article.
      (2)   Amendments. The International Residential Code for One- and Two-Family Dwellings is amended as follows:

FEMA Ordinance, Current; The current flood plain ordinance adopted by the city
 
   (C)   National Electric Code adopted.
      (1)   There is hereby adopted by the city for the purpose of establishing rules and regulations for the construction, alteration, removal and maintenance of electric wiring and apparatus, including permits and penalties, that certain electrical code known as the National Electrical Code of the National Fire Protection Association, being particularly the 2015 edition of the National Electrical Code and the whole thereof, save and except such portions as are hereafter deleted, modified or amended, of which no less than one copy has been and now is filed in the Office of the City Secretary. Such code is hereby adopted and incorporated as fully as if set out at length in this section, and the provisions of such code shall be controlling in the construction, alteration, maintenance or removal of all electric wiring and apparatus within the corporate limits of the city.
      (2)   Amendments. The National Electrical Code is amended as follows:
   Each Reference to "Jurisdiction" or location for insertion of name of jurisdiction shall mean the City of Trinidad, Texas.
   (D)   International Plumbing Code adopted.
      (1)    The 2015 edition of the International Plumbing Code, published by the International Code Council Inc. and all subsequent revisions, standards or supplements thereto, are hereby adopted to regulate and govern the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems and provide for the issuance of permits and collection of fees.
      (2)   The use of lead pipes and pipe fittings that contain more than 8% lead or solders and flux that contains more than 0.2% lead is prohibited in the following circumstances:
         (a)   For installation and repair of any public water supply; and
         (b)   For any plumbing in a residential or nonresidential facility providing water for human consumption and connected to a public drinking water supply system.
         (c)   This requirement will be waived for lead joints that are necessary for repairs to cast iron pipes.
   (E)   International Property Maintenance Code adopted.
      (1)   That certain document, one copy of which is on file in the office of the city secretary, being marked and designated as the “International Property Maintenance Code,” 2015 edition, published by the International Code Council, is hereby adopted as the property maintenance code of the city for the control of building and structures as provided; and each and all of the regulations, provisions, conditions and terms of such “International Property Maintenance Code,” 2015 edition, published by the International Code Council, on file in the office of the city secretary are hereby referred to, adopted and made a part of this section as if fully set out in this section.
      (2)   Amendments. The International Property Maintenance Code is amended as follows:
   Each Reference to “Jurisdiction” or location for insertion of name of jurisdiction shall mean the City of Trinidad, Texas
   Each Reference to “International Electric Code” shall be revised to refer to the current version “National Electric Code” adopted by the City.
   Section 103.1   This code shall be enforced by the Code Enforcement Authority. The Code Enforcement Authority is the person or persons designated by the City Administrator for purposes of making inspections, sending notices, and otherwise enforcing the provisions of this Code.
   Section 103.6   See fee schedule attached to this Ordinance
   Section 301.3   Section 301.3, Vacant Structures and Land, shall be amended to add subsections a through g to read as follows:
            301.3a   All exterior doors and windows shall be kept in sound working condition and free of broken glass.
            301.3b   All exterior doors shall be equipped with a workable lock or locking device and shall be kept securely locked during the period of time said building is vacant.
            301.3c   All windows shall be secured by a latch or lock or other means so as to prevent easy entry into said structure by children or vagrants or other unauthorized persons.
            301.3d   All exterior walls and roofs shall be kept in good repair free of cracks and holes, defective materials, and structural deterioration to keep such building from becoming a breeding place for rodents, insects, and roaches.
            301.3e   The exterior of said building or structure and the premises thereon shall be kept free of any accumulation of paper, hay, moss, or other combustible or flammable rubbish or waste material that has gathered in sufficient quantities to constitute a danger to said building or to any other building or premises in case such waste is ignited.
            301.3f   The exterior of the premises shall be kept free of any accumulation of trash, garbage, rubbish, or any waste material as to constitute an unsanitary condition.
            301.3g   Fences shall be maintained in good repair and gates, if present, shall be locked at all times. Keys or other means of access shall be provided to the fire department for such premises.
   Section 302.4   Twelve inches (12") shall be inserted in the blanks provided.
   Section 302.7   The following phrase shall be added to Section 302.7: “All accessory structures shall be protected from the elements by painting, staining or other waterproofing or surface treatments.”
   Section 304.14   The following phrase shall be inserted in the blank provided: “April 1 to November 1, unless functioning AC is provided.”
   Section 307      Section 307 is hereby deleted.
   Sections 602.3    “October 1 through April 1" shall be inserted in the blanks provided.

   (F)   Permit required; fees; duration of permits; renewal of permits.
      (1)   Building permit fees.
         (a)   The permit costs for all commercial construction, new and remodeled, will be based upon the 1998 UBC Table 1A:

         (b)   The permit costs for new residential construction will be an $450 flat fee plus $0.10 per square foot (Example: for a 3,000 sq. ft. house, the fee would be $450 + $300 [3,000 x 0.10 = $300]).
         (c)   The permit costs for residential remodeling will be $350.
         (d)   Swimming pool fees. For construction and installation of in-ground swimming pools, the fee shall be $300. For above-ground pools, the fee shall be $60.
         (e)   Demolition fee. For the demolition of any building or structures, the fee shall be $60.
         (f)   Penalties. Where work for which a permit is required by this code is started or proceeded prior to obtaining said permit, the fees herein specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this code in the execution of the work nor from any other penalties prescribed herein.
         (g)   Reinspection fees. The fee for reinspection may be $75 for each subsequent inspection, per trade.
         (h)   Irrigation permit fees. The permit fee shall be $75.
         (i)   Electrical service inspection (ESI) fee. For an Electrical Service Inspection (ESI) the fee shall be $75. This fee is for service connection. Service providers engaged in the business of providing electrical service to industrial, commercial or residential customers shall not energize a customer's premise without first having received the electrical inspector's certificate of compliance.
      (2)   A person who is performing work or causing to be performed work on a building or structure will obtain all required permits prior to commencing work. Additional permit fee schedule is attached to this chapter as division (H) is hereby adopted. No building or structure will be constructed, installed, built, or altered unless a permit has first been issued for the work and said permit has not expired in accordance with division (B) of this section.
      (3)   Expiration of permits. Any permits required by this section shall expire 120 days after issuance.
      (4)   Renewal of permits. Expired permits may be renewed for a 30-day period from the date of expiration upon application and payment of the renewal fee set forth in the permit fee schedule attached to this chapter as division (H).
   (G)   Certificate of occupancy.
      (1)   Use or occupancy. No building or structure shall be occupied, and no change in the existing occupancy or classifications of a building or structure or portion thereof shall be made until the building official has issued a certificate of occupancy therefore, as provided herein, and such permit is current and not revoked. Prior to any connection of utilities or transfer of utilities from one name to another or from one location to another, the primary occupant must have been issued a certificate of occupancy or a temporary certificate of occupancy.
      (2)   Certificate issued. After final inspection when it is found that the building or structure complies with the provisions of this chapter and the city subdivision ordinance provisions applicable to such structure, lot, parcel or tract upon which the structure is located, the building official shall issue a certificate of occupancy or completion which shall contain the following:
         (a)   The use and occupancy for which the certificate is issued;
         (b)   A certification that the building or structure complies with the provisions of this section;
         (c)   The permit number of the building or structure;
         (d)   The address of the building or structure;
         (e)   The name and address of the owner and occupant;
         (f)   A description of that portion of the building or structure for which the certificate is issued;
         (g)   A statement that the described portion of the building or structure complies with the requirements of this ordinance for the group and division of occupancy and the use for which the proposed occupancy is classified;
         (h)   The name of the building official.
      (3)   Temporary certificate. A temporary certificate of occupancy may be issued by the building official for the use of a portion or portions of a building or structure prior to the completion of the entire building or structure. The temporary certificate shall state thereon the duration for which the certificate is issued and where no duration is indicated, the certificate shall be for no more than 180 days from the date of issuance.
      (4)   Connections of service utilities. No person shall make connections from a utility source which is regulated by the technical codes for which a permit is required to any building or system until released by the building official and a certificate of occupancy or completion is issued.
      (5)   Temporary connection. The building official may authorize the temporary connection of the building or system to the utility source of energy, fuel or power for the purpose of testing building service systems or for use under a temporary certificate of occupancy.
      (6)   Authority to disconnect utilities. The building official shall have the authority to authorize disconnection of utility service to the building, structure or system regulated by the technical codes, in case of emergency where necessary to eliminate an immediate hazard to the life or property. The building official shall notify the serving utility, and whenever possible the owner and occupant of the building, structure or service system of the decision to disconnect, if possible, prior to taking such action. If not notified prior to disconnecting, the owner or occupant of the building, structure or service system shall be notified in writing, as soon as practical thereafter.
      (7)   Authority to disconnect utilities for failure to obtain a certificate of occupancy or temporary certificate of occupancy. The building official shall have authority to authorize disconnection of utility services to any building, structure or system regulated by the technical codes for which a certificate of occupation has been revoked or is required and has never been issued to the current occupant after written notice and an opportunity to correct as provided herein. Before utilities may be disconnected, the building official shall send a notice specifying that the owner or occupant must bring the property into compliance or the utilities will be disconnected and indicating that the owner or occupant may appeal to the Board of Adjustments within ten days of the date of the letter.

   (I)   International Fire Code.
      (1)   That certain document, one copy of which is on file in the office of the city secretary, being marked and designated as the International Fire Code, 2015 edition, published by the International Code Council, is hereby adopted as the fire code of the city for regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises in the city and providing for the issuance of permits for hazardous uses and operations; and each and all of the regulations, provisions, conditions and terms of such International Fire Code, 2015 edition, published by the International Code Council, on file in the office of the city secretary are hereby referred to, adopted and made a part of this section as if fully set out in this article.
      (2)   Amendments. The International Fire Code is amended as follows:
   Each reference to “jurisdiction” or location for insertion of name of jurisdiction shall mean the City of Trinidad, Texas.
   Section 109.3. Offenses under this code, including penalties and notice, shall be in compliance with Section 4 herein.
   Section 111.4. Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $200.00 dollars or more than $2,000.00 dollars.
      (3)   Limits. The limits referred to in certain sections of the fire code are hereby established as follows:
   Section 3204.3.1.1. The limits referred to in Section 3204.3.1.1. of the International Fire Code in which the storage of flammable cryogenic fluids in stationary containers is restricted, are established as follows: No one shall store in stationary containers any flammable cryogenic fluids, without a permit. Permits will be issued based upon need, quantity and hazards [which] storage presents to occupants and surrounding property.
   Section 3404.2.9.5.1. The limits referred to in Section 3404.2.9.5.1. of the International Fire Code in which the storage of Class I and II liquids in aboveground tanks outside of buildings is restricted, are established as follows: No one may store more than sixty (60) gallons of Class I or II liquids in outside aboveground tanks within the city, without a permit. Permits will be issued based upon need, quantity and hazards which storage presents to occupants and surrounding property.
   Section 3406.2.4.4. The limits referred to in Section 3406.2.4.4 of the International Fire Code in which the storage of Class I and Class II liquids in aboveground tanks is restricted, are established as follows: No one may store Class I and II liquids in aboveground tanks within the city, without a permit. Permits will be issued based upon need, quantity and hazards which storage presents to occupants and surrounding property.
   Section 3804.2. The limits referred to in Section 3804.2 of the International Fire Code, in which storage of liquefied petroleum gas is restricted for the protection of heavily populated or congested areas, are established as follows: No one shall store more than one hundred (100) pounds of liquefied petroleum gases within the city, without a permit. Permits will be issued based upon need, quantity and hazards which storage presents to occupants and surrounding property.
      (4)   Allowable outdoor burning shall be subject to the 2015 International Fire Code including but not limited to the following:
         (a)   Begin burning no earlier than one hour after sunrise, and end the same day, no later than one hour before sunset.
         (b)   Burning must be attended until extinguished.
         (c)   Residual fires or smoldering embers must be extinguished.
         (d)   Remaining debris from burning must be disposed of.
         (e)   Burning must not cause a traffic hazard.
         (f)   Burning shall not contain any prohibited materials, including but not limited to:
            1.   Domestic waste;
            2.   Bulk waste;
            3.   Construction or demolition debris that contains prohibited materials metal wiring, shingles or other asphaltic or petroleum based products;
            4.   Chemical waste;
            5.   Potentially explosive materials such as batteries and aerosol cans;
            6.   Asphalt materials such as shingles;
            7.   Rubber products (natural or synthetic such as tires, electrical wiring insulation );
            8.   Fiberglass products;
            9.   Glass products or containers;
            10.   Metal cans or containers;
            11.   Plastics;
            12.   Oil products such as heavy oil, machine oil, motor oil, transmission fluids, etc.; and
            13.   Any Petroleum based products not specifically identified above.
      (5)   Location. The location for open burning shall not be less than 50 feet from any structure, and provisions shall be made to prevent the fire from spreading to within 50 feet of any structure. Exceptions:
         (a)   Fires in approved containers that are not less than 15 feet from a structure.
         (b)   The minimum required distance from a structure shall be 25 feet where the pile size is three feet or less in diameter and two feet or less in height.
