§ 31.019 AUTHORITY, DUTIES AND RESPONSIBILITIES.
   (A)   The City Administrator shall be the chief administrative officer of the city and shall be responsible to the City Council for the proper administration of all affairs of the city.
   (B)   To that end, the City Administrator shall have the authority, duty and responsibility as required to:
      (1)   Prepare job descriptions for approval by the City Council, delegate duties to the officers and employees of the city, fill budgeted positions of the city, terminate, suspend or discipline any employee, subject to their right of appeal to the City Council, provided that appointments and termination of the Chief of Police and City Secretary shall be with the City Council's concurrence;
      (2)   Ensure that all applicable laws and ordinances are enforced;
      (3)   Attend all meetings of the City Council with the right to participate in the discussion, but having no vote;
      (4)   To assist the Mayor as Chief Budget Officer of the city, pursuant to Tex. Loc. Gov't Code § 102.001, in the preparation, review and submission to the City Council prior to the beginning of each fiscal year of a budget for proposed expenditures for the ensuing year together with a message describing the important features of the budget. The City Administrator shall render assistance as the Mayor may find reasonably necessary in the preparation and submission of the budget. The City Administrator shall further, as directed by the City Council, assist the City Council with respect to its consideration of the budget. The City Administrator shall assure the proper administration of the budget after its adoption by the City Council;
      (5)   Prepare and submit to the City Council, as of the end of the fiscal year, a complete report on the finances and administrative activities of the city for the preceding year;
      (6)   Keep the City Council advised of the financial condition and future needs of the city and provide information and service as may be deemed reasonably necessary by the Mayor as the Chief Budget Officer of the city. The City Administrator shall further advise and assist the City Council to assure the accomplishment of the annual audit pursuant to Tex. Loc. Gov't Code § 103.001;
      (7)   Supervise the purchase of all materials, supplies and equipment for which funds are provided in the budget, purchase budgeted materials and supplies necessary for operation or maintenance of city services for amounts up to and including $4,999.99. All expenditures of $5,000 or more shall be approved by the City Council after competitive bidding procedures of state law. No purchase shall be made, contract let or obligation incurred for any item or service which exceeds the current departmental budget appropriation without a supplemental appropriation approved by the Council. No contract shall be let except by the City Council. The City Administrator shall advise the City Council on the advantages or disadvantages of contract and bid proposals. The City Administrator may issue written rules governing procedures for purchasing consistent with this section and with applicable state law;
      (8)   In the event of accident, disaster or other circumstance creating a public emergency, the City Administrator shall provide the Mayor assistance as may be necessary and may award contracts and make purchases for the purpose of meeting the emergency; but shall file, within 72 hours, with the City Council a certificate describing any emergency and showing the necessity for the emergency purchases, together with an itemized count of all the expenditures; and
      (9)   The City Administrator shall have such further authority, duties and responsibilities as may be reasonably implied from the terms hereof and as heretofore or hereafter provided by the city.
