The reasonable costs and expenses for repairing, re-constructing or correction of any construction activity, excavation, addition, removal or alteration of a facility or any other alteration thereof to any street, right-of-way or facilities located thereon, within the city, without a permit or express written contract or written agreement with the city, shall be charged against the persons, the corporation, company or entity actually responsible for the actions; the owner(s) responsible for the work or for whose benefit the activity was undertaken which caused the damage to the street or right-of-way; and/or the permittee in whose name the permit to perform the activities was issued.
