(A) A person who wishes to apply for a permit under this subchapter shall submit a completed application on the form provided the city to the City Administrator. Such application shall contain:
(1) The name, address, phone and fax number of the person requesting the permit;
(2) The name, address, phone, and fax number of the owner of the motor vehicle or vehicles to be operated under the permit, if different from the person requesting the permit;
(3) The make, model, license number, weight (loaded and unloaded) of each vehicle to be operated under the permit;
(4) The dates for which a permit is requested;
(5) The proposed number of trips per day for each vehicle;
(6) Proof that each person who will operate a motor vehicle under the permit holds insurance compliant with the Texas Transportation Code;
(7) The route of travel in the city; and
(8) Any other information required to be provided by the city.
(B) The application shall be accompanied by a permit fee of $150, and any fees charged to the city by the City Engineer to review the application.
(C) Before the City Administrator shall issue a permit under this subchapter, the applicant shall file with the city a surety bond in a form acceptable to the city in the amount of no less than $50,000 conditioned that the owner of the motor vehicle will pay the city any damage to a city street or city property caused by the operation of the motor vehicle(s). The bond shall be released only upon inspection and determination by the City Engineer that the vehicle did not damage city streets or property.
(D) The City Administrator may issue a permit if the motor vehicle weight and proposed number of trips per day will not exceed the design standards for the street(s) to be used as determined by the City Engineer, taking into account any other permits that may have been issued for the same dates and routes. The permit shall be issued for a maximum period of 30 days. The permit shall list the motor vehicles authorized to operate under the permit, the authorized number of trips per day, the date during which the permit is in effect, and any other conditions of the permit.
(E) The applicant may appeal a denial of a permit application to the City Council by submitting written notice to the City Administrator within ten days of the permit denial. The appeal shall be scheduled for the next regular City Council meeting for which notice may be lawfully provided.
(F) The permit holder shall keep a written log of the number of trips per day for each motor vehicle authorized under the permit and shall submit the log daily to the City Administrator.
