Section IV. General Application.
   A.   General: Except as hereinafter provided:
   No building shall be erected and no existing building shall be moved, altered, added to, or enlarged, nor shall any land, building or premises be used, designated or intended to be used for any purpose or in any manner other than is included among the uses hereinafter listed as permitted in the district in which building, land, or premises is located.
   No sign shall be erected, moved altered, added to, enlarged, painted, or modified, except in conformity to the sign regulations. No building shall be erected, nor shall any existing building be altered, enlarged or rebuilt, nor shall any open space surrounding any building be encroached upon or reduced in any manner, except in conformity with the yard, building, site, area and building location regulations hereinafter designated for the district in which such building or open space is located. No yard or open space provided about any building for the purpose of complying with provisions of this Ordinance shall be considered as providing a yard or open space for a building on any other lot.
   No building, structure or accessory structure shall be erected, converted or enlarged, nor shall any such existing building or structure be structurally altered or rebuilt, nor shall any open space surrounding any building be encroached upon or reduced in any manner, unless the same shall be done and completed in a manner to comply with all applicable City codes and ordinances, and such work and structure shall:
      a.   Conform to the setback, building site area, building location and land use regulations hereinafter designated for the district in which such building or open space is located.
      b.   Not exceed the height limit herein established for the district in which such building is located, except as specifically authorized as follows.
   B.   Permitted Uses: The following describes permitted uses in the established zoning districts.
      1.   R-1 Residential District - In the R-1 District, no building or land shall be used and no building shall be hereafter erected, converted, or structurally altered, unless otherwise provided herein, except for the following uses:
         Single family buildings, modular components that comply with this Section, and accessory uses thereto (including Residential Accessory Structures), public uses authorized for the R-1 District in Section IV(C) provided they comply with Development Standards for R-1 zones., and the uses authorized for the R-1 District in Section IV(C).
         No recreational vehicles or travel trailers may be parked and/or used for lodging/overnight stays or hooked up to utilities in the R-1 District.
      2.   R-2 Residential District - In the R-2 District, no building or land shall be used and no building shall be hereafter erected, converted, or structurally altered, unless otherwise provided herein, except for the following uses:
         Single family dwellings, duplexes, modular components that comply with this Section, uses authorized for the R-2 District in Section IV(C), and accessory uses thereto (including Residential Accessory Structures).
         No recreational vehicles or travel trailers may be parked and/or used for lodging/overnight stays or hooked up to utilities in the R-2 District.
      3.   MF-1 Multi-Family District - In the MF-1 District, no building or land shall be used and no building shall be hereafter erected, converted, or structurally altered, unless otherwise provided herein, except for the following uses:
         Single family homes, duplexes, apartments, uses authorized for the MF-1 District in Section IV(C), and accessory uses thereto (including Residential Accessory Structures).
         No recreational vehicles or travel trailers may be parked and/or used for lodging/overnight stays or hooked up to utilities in the MF-1 District.
      4.   M-1 Manufactured Home Subdivision District - In the M-1 District, no building or land shall be used and no building shall be hereafter erected, converted, or structurally altered, unless otherwise provided herein, except for the following uses:
         The uses authorized in Section IV-A.
      5.   M-2 Manufactured Home Park District-District - In the M-2 District, no building or land shall be used and no building shall be hereafter erected, converted, or structurally altered, unless otherwise provided herein, except for the following uses:
         The uses authorized in Section IV-B.
      6.   C-1 Commercial District - In the C-1 District, no building or land shall be used and no building shall be hereafter erected, converted or structurally altered unless otherwise provided herein, except for the following uses:
         Professional buildings, offices, enclosed storage, flammable liquids or gases, public and private parking, assembly uses, private schools, nursing homes, food manufacturers and food processing not involving animals or animal processing, hotels, motels, convenience stores, lodging houses, furniture assembly, automobile service and repair, car washes, restaurants, auto sales, other retail sales, drive-in services, and any commercial recreational facilities, drinking and eating establishments (except for private clubs), accessory uses to the above uses (including Commercial Accessory Structures), and uses authorized for the C-1 District in Section IV(C).
         No recreational vehicles or travel trailers may be used for lodging/overnight stays or hooked up to utilities in the C-1 District. Travel trailers and recreational vehicles may be parked for repairs, sales or services with/from businesses located in such C-1 District.
      7.   C-2 Commercial District - In the C-2 District, no building or land shall be used and no building shall be hereafter erected, converted or structurally altered unless otherwise provided herein, except for the following uses:
         All uses allowed in the C-1 District, private clubs, and uses authorized for the C-2 District in Section IV(C).
         No recreational vehicles or travel trailers may be used for lodging/overnight stays or hooked up to utilities in the C-2 District. Travel trailers and recreational vehicles may be parked for repairs, sales or services with/from businesses located in such C-2 District.
      8.   I-1 Industrial District - In the I-1 District, no building or land shall be used and no building shall be hereafter erected, converted or structurally altered unless otherwise provided herein, except for the following uses:
         Industries which do not emit noxious odors, or offensive noises, or lint or smoke or smog and which enclose all activity as authorized for the I-1 District in Section IV(C); assembly, manufacturing, fabrication and mixing plants; and residences of security guards, firemen and persons employed at the place of activity.
         No recreational vehicles or travel trailers may be used for lodging/overnight stays or hooked up to utilities in the I-1 District. Travel trailers and recreational vehicles may be parked for repairs, sales or services with/from businesses located in such 1-1 District.
      9.   I-2 Industrial District - In the I-2 District, no building or land shall be used and no building shall be hereafter erected, converted or structurally altered unless otherwise provided herein, except for the following uses:
         Industries which emit noxious odors, offensive noises, or lint, smoke, smog, or other airborne particulates as authorized for the I-2 District in Section IV(C).
         No recreational vehicles or travel trailers may be used for lodging/overnight stays or hooked up to utilities in the I-2 District. Travel trailers and recreational vehicles may be parked for repairs, sales or services with/from businesses located in such I-2 District.
      10.   A - Agricultural District - There exists in fringe areas of the City land which is presently used for agricultural purposes. These lands may continue to be used for agricultural purposes until needed for urban purposes in conformity with the orderly growth of the City. The uses permitted in the A-Agricultural District are intended to accommodate the normal farming, ranching and gardening activities, and include single family residences on 1 acre or more of land; ranches, farms, gardens, stables, green houses and other agrarian uses; accessory uses; and uses authorized for the A District in Section IV(C). It is anticipated that all of the A-Agricultural District Area will eventually be changed to other zoning categories as the area within the corporate limits of the City becomes fully developed.
         On parcels over ten (10) acres and larger, recreational vehicles or travel trailers may be parked and used for short term (10 days or less) lodging/overnight stays so long as there exists at least one single family residence. Such recreational vehicle or travel trailer shall not be hooked up to utilities in the A District.
         All property newly annexed to the City of Trinidad shall be temporarily classified as A- Agricultural District, until such time as permanent zoning has been established by the City Council.
      11.   PD - Planned Development District - The Trinidad City Council may authorize, by amendments to this Zoning Ordinance, creation of special districts of a type not conforming to the districts previously addressed herein, after public hearing, proper notice to affected parties, and upon recommendation of the Trinidad Planning and Zoning Commission. Such special districts shall be known as Planned Development Districts, and may include commercial shopping centers, housing developments, mobile home parks, industrial parks, office parks, or a combination of these uses.
         To establish a Planned Development District under this section, the City Council must require the submittal of a comprehensive site plan of the development. The site plan must include provisions for site access, all streets or drives, right of way, utilities, drainage, parking spaces, lot coverage, yards, open spaces, and such other development requirements as may be requested by the City. In approving a Planned Development District, the City Council may impose conditions relative to the standard of development, and such conditions must be complied with prior to the issuance of a Certificate of Occupancy.
      12.   P - Public Lands District - In the P District, no building or land shall be used and no building shall be hereafter erected, converted or structurally altered unless otherwise provided herein, except for the following uses:
         Parks, public schools, playgrounds, public cemeteries, public owned buildings and lands, churches, fire stations, public utilities, such as water storage and wastewater collection and treatment facilities, and uses authorized for the P District in Section IV(C).
         A recommendation of the proper zoning classification for types of land use which are not identified in this ordinance shall be made by the Planning and Zoning Commission, after consideration of the compatibility of the proposed use with the uses permitted in other districts. Uses not specifically identified herein may be authorized in a district by special permit, provided said uses are compatible with existing and permitted uses, and do not cause excessive traffic, noise, smoke or other environmental pollutants. The recommendation of the Planning and Zoning Commission shall be referred to the City Council for final approval.
   C.   Legend for Interpreting Permitted Uses.
