Existing private swimming pools and small private swimming pools that do not conform to the requirements of this chapter shall be brought into compliance therewith not later than April 30, 2007. The Building Inspector shall have the power to make exceptions to and modifications of the above requirements for fences as to existing private swimming pools, in cases in which such requirements are not essential to safety and the enforcement thereof would work a hardship on the owners. However, all small private swimming pools shall be subject to the provisions of Section 1432.05(a) without exception.
