Prior to or simultaneously with submission of a final plat for Council approval, the subdivider shall also do the following:
(a) Submit a fully executed subdivider's contract in the form prescribed by the City.
(b) (1) Submit a performance guaranty satisfactory to the City. The following forms of guaranty are always acceptable:
A. A performance bond issued by a surety licensed by the State of Ohio.
B. A cash bond.
(2) The following forms of guaranty may be acceptable, in the City's sole discretion:
A. An assignment of real estate in a form and value acceptable to the City.
B. An assignment of account in a form and amount acceptable to the City.
C. A letter of credit in a form and amount acceptable to the City.
(3) See Section 1212.01 of these regulations for more details on the various kinds of performance guarantees and their applicability.
(4) In lieu of providing a performance guaranty, the subdivider may elect to construct the public improvements and private improvements within common areas after receiving approval of the construction plan, but before approval of the final plat. In such event, the subdivider shall obtain and pay for all plan reviews and inspections required by these regulations before applying for approval of the final plat.
(c) Submit executed deeds for all dedications and easements not to be accomplished within the final plat.
(d) The subdivider must submit a certificate of title to the Planning and Zoning Administrator which shows the ownership of all lands to be dedicated to the public and that the title thereof is free and unencumbered. If the title is not free and unencumbered, then two requirements shall be met:
(1) If a mortgage exists on the property which is dedicated to the public, a release of mortgage must be filed with the County Recorder's office. Otherwise the bank or whoever holds title to the mortgage on the property must sign the record plat;
(2) If an easement of record exists through any proposed right-of-way that is to be dedicated to the public, that easement must either be subordinated to the City or vacated.
(e) The subdivider must submit to the Zoning Administrator the mylar drawing of the subdivision that shall be signed and stamped by a registered surveyor. All owners and mortgage holders signatures must be notarized and dated and have 2 witnesses per signature.
(f) The subdivider must pay all review fees outstanding with the City.
