1046.01 STORM WATER UTILITY CHARGE
   (a)   The City Manager or his or her designate shall classify and charge a monthly storm water utility charge to each non-governmental property in the City based on the criteria and Equivalent Residential Unit (ERU) formula described in divisions (a)(1) through (a)(3). A property shall be invoiced separately if it is recorded as a distinct property or if the Planning Commission has approved the subdivision of a larger lot into distinct properties, as delineated on either a preliminary plat plan or other appropriate drawing acceptable to the Planning Commission.
      (1)   Properties classified residential shall include only those properties occupied or, if vacant, zoned for churches and single- or multiple family residences, up to and including apartment houses with 3 units or less. Properties consisting of both residential and commercial uses shall be classified as commercial. A residential property shall be charged either one ERU per 3,000 thousand square feet of lot size or the Minimum Residential/AW Charge per month, whichever is greater;
      (2)   Properties classified AW (Agricultural/Well Field) shall include only those properties taxed by the County Auditor’s Office at the CAUV property tax rate, or properties that are designated as well field protection areas. AW properties equal to or greater than 1 acre in size shall be charged 15 ERUs per property, regardless of square footage. AW properties less than 1 acre in size shall be charged as a residential property.
      (3)   Properties classified commercial shall include, but not be limited to industrial, business, schools, and apartment houses with four units or more, shall be either charged five ERUs per 3,000 square feet of lot size or Minimum Commercial Charge, whichever is greater.

      (2)   The determination of the appropriate ERUs to assign each property shall be made by the City Manager or his or her designate. It shall be the sole responsibility of the property owner to resolve any ownership, lot size, or other related issues.
      (3)   The calculation shall be as follows:
         A.   Monthly residential charge: Monthly ERU times square footage of property divided by 3,000, or Residential/AW Minimum Charge, whichever is greater
         B.   Monthly AW charge: If property is greater than 1 acre in size: Monthly ERU times 15, or if property is less than 1 acre in size: use Monthly Residential Charge calculation.
         C.   Monthly commercial charge: Monthly ERU X 5 times square footage of property divided by 3,000, or Commercial Minimum Charge, whichever is greater.
