There is hereby levied and assessed upon each premises having any sewer connection with or having access to the sanitary sewerage system of the City, or otherwise discharging sewage or industrial wastes into the system, a sewer service charge or rental, payable as hereinafter provided and in an amount determinable for all users of the City sanitary sewerage system, except as otherwise provided in this chapter.
The rate shall be as follows:
(a) Nonindustrial Users. Nonindustrial users shall pay the following monthly charges, effective the first day of January of the identified year.

(1) On January 1, 2011 and on that date each year thereafter, the monthly minimum charges and consumption rates shall be increased by the Treasurer, in an amount not to exceed the rate of inflation as determined by the Consumer Price Index (CPI) annual increase as of the most recent month reported for the previous year. The rates to be charged to volume industrial or commercial users may be established by special schedules or contracts to be determined by Council.
(2) A user who is 65 years of age or older or is permanently and totally disabled, and who qualifies for a 60% or greater reduction of taxable value under Ohio R.C. 323.152, shall be entitled to a reduction of three dollars and twenty cents ($3.20) on the minimum charge for any month that the user uses 2,000 gallons or less, after the Treasurer has approved the user’s application for such a reduction. Each user applying for a reduction shall renew his or her application annually with the Treasurer.
(b) Industrial Users. It is hereby determined that all receipts of wastewater treatment service on the effective date of Ordinance 12-77, passed May 5, 1977, are classified as nonindustrial users. In the future, should any industrial user utilize any grant-funded facility, the City shall, in accordance with 40 C.F.R. Part 35, as amended, enact the necessary industrial cost recovery system legislation.
