1040.365 REGIONAL WASTEWATER TREATMENT PLANT CAPACITY FEE.
    (a)   Prior to the application for a building sewer permit from the Health Officer, there shall be collected from each applicant a wastewater treatment plant and trunk sewer capacity fee by the County Department of Water and Sewers for each residence, business, industry, structure or use according to the schedule set forth in division (b) hereof. Such fees shall be the most current as adopted by the Board of County Commissioners and filed with the City Manager.
   (b)   Wastewater treatment plant and trunk sewer capacity fees shall be computed on the basis of Equivalent Residential Units (ERUs). One ERU is hereby defined as the average sewage flow capacity expected from a typical detached single-family dwelling. All uses other than single-family dwellings shall be expressed in fractions or multiples of one ERU.

   NOTE:
       (1)   Intermediate classifications can be established at any multiple of 12,000 gallons/month with 1 ERU charged per 12,000 gallons/month maximum base rate usage.
      (2)   Peak use surcharges shall be applied to all wastewater discharge in excess of the established maximum monthly use. Charges for volumes of commercial or industrial wastewater are subject to 150% and 200% peaking charges times the base rate for commercial and industrial customers as provided for by the Butler County ERU (Equivalent Residential Unit) Program.
      (3)   Customers can be reclassified to a higher maximum monthly use classification to avoid peak use surcharges by paying the additional connection fees applicable to the higher classification less credit for the fees previously paid.
