880.05 PERMIT REQUIRED.
   (a)   Although this chapter is business regulation and not zoning, the Board of Zoning Appeals, as an objective quasi-judicial body, shall have jurisdiction to determine whether the requirements of this chapter have been met by a proposed facility. A permit for the establishment of an adult entertainment facility shall be issued by the City Manager upon receipt of a written finding by the Board of Zoning Appeals that the location and design requirements of this chapter will not be violated by the proposed facility, together with the City Manager's finding of compliance with all other legal requirements of the City. Permits may be issued only to 1 or more specific individuals, and may not be issued to incorporeal entities such as corporations, partnerships and limited liability companies. The Board of Zoning Appeals may adopt such rules, regulations and forms as it may find necessary to obtain information and assurances from the applicant and determine whether a permit should be issued.
   (b)   Each permit granted shall be in effect for a period of 5 years unless revoked or abandoned. A permit shall be deemed abandoned if the facility ceases doing business for a period of 30 days or more. Renewals require a new application and application fee.
