(a) All buildings owned and occupied by the City are hereby declared to be tobacco free facilities.
(b) No person shall use or smoke tobacco in any building owned and occupied by the City or its officers or employees.
(c) Any person violating division (b) of this section shall be deemed a trespasser and may be prosecuted for repeated violations of this section.
(d) City employees who violate this section will be encouraged to participate in the City's Employee Assistance Program or other counseling so as not to use or smoke tobacco in the City's buildings. Repeated violations shall result in disciplinary action, including, but not limited to, withholding of a promotion, reassignment, temporary suspension without pay, reduction in placement or termination of employment.
(e) The occupants of buildings owned by the City shall be encouraged to adopt the same or similar policies for the use of City buildings.
