§ 131.08 DEPOSIT OF YARD WASTE AND REFUSE AT VILLAGE REFUSE FACILITIES.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      COMMERCIAL YARD SERVICE. Any business or person who is hired by a village resident for the purpose of mowing, trimming or cleanup of property owned or leased by a village resident.
      POSTED NOTICES. Any sign posted upon property owned, leased or used by the village for whatever purpose, that dictates the laws, rules and regulation for use of said property.
      REFUSE SITE. The designated site currently located at the village sewer treatment plant and used for the deposit of yard waste and refuse or at a future site designated for that purpose by the village.
      RESIDENTS. The term resident shall include all persons residing upon property located within the village limits, all persons owning residential, business and commercial property located within the village limits and all commercial lawn care businesses hired by such persons for the purpose of yard maintenance.
      VILLAGE YARD WASTE AND REFUSE FACILITIES. The facility currently located at the village sewer treatment plant located at W. Franklin Street or at any future location as from time to time designated as such by the Village Corporate Authorities.
      YARD WASTE AND REFUSE. Includes grass clippings, shrub and bush clippings, flower and plant clippings, trees and tree branches and leaves; except in the fail between the months of September thru December of each year when the deposit of leaves will not be allowed.
   (B)   Those allowed to deposit yard waste and refuse at refuse sites. Residents of the village are permitted to deposit yard waste or refuse at the designated refuse site, subject to the rules and regulations set forth in this section or posted at the site.
   (C)   Those prohibited from depositing yard waste and refuse at refuse sites. Any person not a resident of the village as defined in this section is prohibited from dumping yard waste or other refuse on any property within the village limits.
   (B)   Violation. It shall be unlawful for any person not a resident of the village or any resident to dump or deposit any yard waste or other garbage or refuse at the designated yard waste or refuse disposal site located at the village sewer treatment plant, or at such other designated site designed for the deposit of such waste or refuse, in violation of this section or in violation of posted notices at such site, or at any other location within the village not designated for such purpose. It shall also be unlawful for any resident to dump or deposit any such yard waste or refuse obtained from sources outside the village limits or to dump or deposit yard waste or refuse when such facility is posted as closed. Any person violating any provision of this section shall be fined as provided by § 131.99.
   (D)   Payment. Any person wishing to settle and compromise an offense shall pay the required amount on or before the date specified in the notice of violation, which date will be approximately ten days from the date on which the notice of violation is given. The payment can be made either by mailing a check or money order, together with the violator’s copy of the ticket to the Village of Tremont, 211 S. Sampson Street, Tremont, IL. 61568, or by paying the same in person at the Village Hall during regular business hours. Checks or money orders should be made payable to the “Village of Tremont.”
