It shall be unlawful and it is hereby declared a nuisance for any person to erect or maintain any privy within 40 feet of any street, dwelling, ship, school, factory, church, public hall or within 100 feet of any well, unless the same is furnished with a substantial vault, six feet deep, and made tight so that the contents cannot escape therefrom, and is sufficiently secured and enclosed.
