(A) The identified floodplain area may be revised or modified by the Borough Council where studies or information provided by a qualified agency or person documents the need for such revision. However, prior to any such change, approval must be obtained from the FEMA. Additionally, as soon as practicable, but not later than six months after the date such information becomes available, a community shall notify the FEMA for a letter of map revision (LOMR) of the changes by submitting technical or scientific data. The situations when a LOMR or a conditional letter of map revision (CLOMR) are required are:
(1) Any development that causes a rise in the base flood elevations within the floodway;
(2) Any development occurring in Zones A1-30 and Zone AE without a designated floodway, which will cause a rise of more than one foot in the base flood elevation; or
(3) Alteration or relocation of a stream (including but not limited to installing culverts and bridges).
(B) Any new construction, development, uses or activities allowed within any identified floodplain area shall be undertaken in strict compliance with the provisions contained in this chapter and any other applicable codes, ordinances and regulations.
(C) Within any identified floodplain area (see § 151.051), no new construction or development shall be located within the area measured 50 feet landward from the top-of-bank of any watercourse, unless a permit is obtained from the Department of Environmental Protection Regional Office.
