This is an updating of the borough curfew ordinance of 1979 prescribing, in accordance with prevailing constitutional and community standards, regulations for the conduct of minors on streets and public places including the borough parks and recreation areas at night, effectively enforced, for the benefit of minors, for the furtherance of family responsibility, and for the public good, safety and welfare.
(A) Council finds that the continuance and redefining of the curfew meets a community need, has been over the years a significant factor in minimizing juvenile delinquency and should be updated and amplified in the light of the borough’s local situation including recent acts of vandalism and juvenile defiance of authority. The borough has a park system, swimming pool and recreation facilities for all ages. This community sense of the proper time for cessation of outdoor activities by minors on the streets is reflected in the curfew hours declared by this chapter, which takes into consideration also the danger hours for nocturnal crime and for the gathering of minors with potential risks incident to immaturity.
(B) Council finds that the borough has adequate facilities for lawful recreation during non-curfew hours for all ages including juveniles.
