(A) No person shall discharge wastewater containing in excess of the following maximum concentrations, unless waived by Council upon indication that a higher concentration is not detrimental to the sewerage system, treatment process, or stream discharge limitations. In the event of such a waiver, Council reserves the right to impose surcharges on the user’s regular sewer billings, to account for extra treatment costs.

(B) (1) The surcharge on a user’s regular sewer billing for discharges exceeding a maximum pollutant concentration shall be calculated from the following formula:
Surcharge = 8.34 x QGC/1,000,000 x [(PSR - PDL) x (Annual O&M Expense for Pollutant per pound)] |
QGC = Quarterly Gallons Consumed
PSR = Pollutant Sampling Result
PDL = Pollutant Discharge Limit
(2) The annual operation and maintenance (O&M) expense for each pound of pollutant treated shall be determined each year by examining the audited expenses of the borough’s wastewater operations for the previous year. The borough’s Engineer shall determine the apportionment of treatment expenses for each pollutant.
