§ 31.20 POWERS AND DUTIES.
   (A)   The Borough Manager shall be the chief administrative officer of the borough, and he or she shall be responsible to the Borough Council as a whole for the proper and efficient administration of the affairs of the borough placed in his or her charge. The powers and duties of administration of all borough business shall be vested in the Manager, unless expressly imposed or conferred by statute, ordinance or resolution upon other borough officers or officials.
   (B)   Subject to recall or amendment by subsequent ordinance or resolution of the Borough Council, the powers and duties of the Borough Manager shall include the following.
      (1)   The Borough Manager shall supervise and be responsible for the activities of all municipal departments, except such departments the supervision of which shall not have been delegated to the Manager by the Mayor or by the Council, as the case may be. Nothing in this provision is intended, however, to apply to the office of the Borough Solicitor or Borough Engineer or to supervision of the Police Department in the absence of a delegation of authority from the Mayor.
      (2)   The Borough Manager shall recommend to Borough Council candidates for hiring of personnel who will be under his or her supervision, when Council has agreed to fill such positions.
      (3)   The Borough Manager shall make recommendations to Borough Council with respect to discipline and discharge of personnel under his or her supervision.
      (4)   In the event of suspected serious misconduct of an employee under his or her supervision, the Borough Manager may, after consultation with the President of Borough Council (or the Vice President of Borough Council in the event of absence or incapacity of the President of Borough Council), and consultation with the Borough Solicitor, suspend an employee pending the outcome investigation of the alleged misconduct, provided that the Manager shall report at the next meeting thereafter of the Council and action taken by authority of this section.
      (5)   The Manager shall recommend to Borough Council wages, salaries and benefits of all personnel under his or her supervision.
      (6)   The Manager shall prepare and submit to the Council, before the close of each fiscal year, a budget for the next fiscal year and an explanatory budget message in such a timely fashion as will enable the Borough Council to consider and adopt the budget and related tax ordinances according to the requirements of law. In preparing the budget, the Manager, or an officer designated by him or her, shall obtain estimates of revenues and expenditures and such other supporting data as is required. The Manager shall review such estimates and may revise them before submitting the budget to the Council.
      (7)   The Manager shall be responsible for the administration of the budget after its adoption by the Council.
      (8)   The Manager shall, at the request of Borough Council develop long-range fiscal plans for the municipality, to be presented as requested by Borough Council for its review and adoption. No borough funds shall be expended in the development or preparation of such long-range plans without the express approval of Borough Council.
      (9)   The Manager shall hold other borough offices and head such borough departments as the Borough Council may, from time to time, direct, unless holding such office or position is declared incompatible by statute.
      (10)   The Manager shall attend all meetings of Borough Council and its committees with the right to take part in the discussions, and he or she shall receive notice of all special meetings of the Council and its committees.
      (11)   The Manager shall prepare the agenda for each meeting of the Council and supply facts pertinent thereto.
      (12)   The Manager shall keep the Borough Council informed as to the conduct of the borough affairs; submit monthly reports on the condition of the Borough finances and such other reports as the Borough Council requests; and make such recommendations to the Borough Council as he or she deems advisable.
      (13)   The Manager shall submit to the Borough Council, not more than 30 days after the close of the fiscal year, a report on the finances and administrative activities of the borough for the preceding year. This report shall include the beginning balances for each account at the beginning of the fiscal year, revenues and expenditures through the fiscal year, the end-of-year balance for each account and any other information requested by Borough Council.
      (14)   The Manager shall see that the provisions of all franchises, leases, permits and privileges granted by the Borough Council are observed, and shall immediately bring any complaints or problems regarding the same to the attention of Borough Council.
      (15)   The Manager shall supervise the performance and faithful extension of contracts entered into by the borough, except insofar as such duties are expressly imposed by statute upon some other borough officer.
      (16)   The Manager shall see that all money owed the borough is promptly paid and, in conjunction with Borough Council and the Borough Solicitor, ensure that the proper proceedings are taken for security and collection of the borough’s claims.
      (17)   The Borough Manager shall serve as the purchasing officer of the borough and purchase, in accordance with the provisions of the Borough Code, all supplies and equipment for the agencies, boards, departments and other offices of the borough. The Manager shall keep an account of all purchases and shall, from time to time, or when directed by the Council, make a full written report thereof. The Manager shall also issue rules and regulations, subject to the approval of the Borough Council, governing the procurement of all municipal supplies and equipment.
      (18)   All complaints regarding borough services shall be referred to the office of the Manager. The Manager or an officer designated by the Manager shall investigate and dispose of such complaints, and the Manager shall report thereon to the Council.
      (19)   The Borough Manager shall perform such duties as may be, from time to time, conferred upon the Borough Manager by ordinance, resolution, motion or directive of Borough Council.
      (20)   The Borough Manager shall be responsible for ensuring the operation, repair and maintenance of the borough’s vehicles.
      (21)   The Borough Manager shall be responsible for ensuring the maintenance, repair and upkeep of the physical equipment of the borough.
      (22)   The Borough Manager shall cooperate with the Borough Council, at all times, and in all matters that the best interest of the borough and the general public may be served and maintained.
