§ 34.06 ECONOMIC REVITALIZATION AREAS.
   The Town Council does hereby establish a procedure for designation of areas by interested persons as economic revitalization areas, as defined by I.C. 6-1.1-12.1-1 et seq., said procedure being as follows.
   (A)   A person who desires designation of an area as an economic revitalization area, as defined by I.C. 6-1.1-12.1-1, shall file an application at the office of the town’s Clerk-Treasurer and pay a filing fee of $50; provided, however, that, no filing fee shall be required for an owner-occupied, single-family project.
   (B)   The application shall be on a form provided by the town’s Clerk-Treasurer. The form shall require the applicant to provide, among other things, either:
      (1)   Maps and plats that identify the proposed economic revitalization area; or
      (2)   A simplified description of the boundaries of the proposed economic revitalization area describing its location in relation to public ways, streams or otherwise.
   (C)   On receipt of such application, the town’s Clerk-Treasurer shall:
      (1)   Note the date of filing on the application and record the date in the records in the town; and
      (2)   Forward the petition to the Town Attorney with a request for the preparation of a declaratory resolution for the consideration by the Town Council, designating the area described in the petition as an economic revitalization area.
   (D)   The Town Attorney shall prepare a declaratory resolution and forward the application and said resolution to the town’s Clerk-Treasurer and shall include the same in the new business portion of the agenda of the Town Council meeting at its next regular meeting.
   (E)   The town’s Clerk-Treasurer shall establish and apply to such application and resolution, a system of numbering corresponding to that adopted by said town.
   (F)   Upon introduction of the declaratory resolution, the same shall be eligible for passage on the same date as introduced, subject to the following procedure.
      (1)   Upon adoption of the resolution, the resolution shall be filed with the County Assessor and/or Auditor, pursuant to I.C. 6-1.1-12.1-1 et seq.
      (2)   The town’s Clerk-Treasurer shall publish notice in accordance with I.C. 5-3-1 of the adoption and substance of the resolution and setting the resolution for public hearing.
      (3)   The Town Council shall hold a public hearing provided for herein, the Town Council shall take final action on such declaratory resolution by either confirming, modifying and confirming or rescinding said resolution.
      (4)   The following standards shall be applicable, in the sole discretion of the Town Council to the deductions in I.C. 6-1.1-12.1 et seq.:
         (a)   Real property, industrial zoned areas only; and
         (b)   New manufacturing equipment situated or to be situated upon industrial zoned real property and meeting the definition set forth in I.C. 6-1.1-12.1-1(3)(B).
   (G)   The Town Council does hereby designate those areas on the attached map as economic revitalization areas, and said map showing said areas is on file at the office of the County Assessor for public inspection. Said may has been certified by the town’s Clerk-Treasurer and is subject to amendment, confirmation, rescission or remonstrance by any person, in accordance with the provisions of I.C. 6-1.1-12.1-1 et seq.
   (H)   The town has all of the powers for designating economic revitalization areas contained in I.C. 6-1.1-12.1-1 et seq.
