(A) The Town Council, states that before any street cut, boring underneath a street, the introduction of any utility or other construction activities to occur around, under or across the right-of-way of the town and/or its town streets, including driveways or curb cuts, a detailed drawing concerning said boring, cut or construction activity shall be submitted to the town and a request for a permit be made.
(B) If these requests are concerning minor construction or utility matters, that said application shall be reviewed by the Town Manager and/or Clerk-Treasurer, and approval of same may be made, with permit being issued.
(C) All other matters considered major in nature shall be submitted to the Town Council for its approval prior to the execution and issuance of any permit.
(D) If the cut is emergency in nature, the term EMERGENCY shall mean the repair of a utility which must be made to restore service, to avoid property damage or to eliminate danger to the public. Notice of an emergency pavement cut shall be given to the town by telephone during normal business hours. If the cut is made after normal business hours, then notification shall be given at the beginning of the next business day. An application will be made for a permit for all emergency cuts within 72 hours after the cut has been made. All other provisions of this section shall apply to emergency cuts.
(E) A permit fee of $50 shall be charged, except in the case of a utility, said fee shall be waived.
(F) The application attached to the ordinance codified herein as Exhibit “A” shall be filed with the payment of same fee or at the time said fee is waived.
