§ 30.34 AREA PLANNING DEPARTMENT.
   (A)   It is the declared intention of the Town Council to avail itself of the provisions of Ch. 138, Acts of 1957, as amended, State General Assembly, and to participate in the operation of the Area Planning Department after it is established, pursuant to § 6 of said Act.
   (B)   The Town Council hereby adopt the provisions of Ch. 138, Acts of 1957, as amended, State General Assembly.
   (C)   The membership of the Area Plan Commission of the county shall be as set forth in §§ 8 through 13 and in § 25 of said Act.
   (D)   There shall be five county representatives on the Area Plan Commission who shall be selected and appointed as follows:
      (1)   A representative appointed by the School Corporation Superintendents within the jurisdiction of the Area Plan Commission;
      (2)   The County Extension Agent;
      (3)   One citizen member appointed by the Board of County Commissioners;
      (4)   One citizen member appointed by the County Council; and
      (5)   The Board of County Commissioners shall appoint one member who shall be experienced in engineering and survey and who may be an employee of the county’s Engineering Department.
   (E)   The legislative body of each of the participating towns shall each appoint one member to the county’s Area Plan Commission, which member may be a member of the legislative body of such town or may be a citizen member as the term “citizen member” is defined in I.C. 18-7-4-216(c).
   (F)   One citizen member shall be appointed because of his or her knowledge and experience in community affairs and his or her awareness of agricultural problems in the area by the consensus of the following groups:
      (1)   County Farm Bureau, Inc.;
      (2)   County Extension Board;
      (3)   Board of Supervisors of the Soil and Water Conservation District in the county; and
      (4)   The County Agricultural Stabilization Committee.
   (G)   A member of the Area Plan Commission, Board of Zoning Appeals or a legislative body may not participate in a hearing or decision of that Commission or body concerning a zoning or subdivision matter in which he or she has a direct or indirect financial interest. The fact of employment by the Engineering Department of the county shall not create such interest in any member appointed from such Department to the county’s Area Plan Commission as will disqualify such member from acting on any zoning or subdivision matter brought before the Area Plan Commission. If any member of the Area Plan Commission or Board of Zoning Appeals shall have a conflict of interest, the Commission or Board shall enter in its records the fact that its member has such a disqualification and the remaining members of the Commission shall appoint an elector to participate as a member in the hearing or decision concerning that zoning or subdivision matter.
   (H)   The town does hereby establish itself as a participating member of the county’s Plan Commission and hereby adopts and includes herein by reference the county’s zoning ordinances and subdivision control ordinances and all amendments, rules and regulations established pursuant thereto.
