§ 91.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Whosoever shall violate the terms and conditions of § 91.01 of this chapter shall be punished as follows:
         (a)   First offense: Class C infraction, fine of $50;
         (b)   Second offense: Class B infraction, fine of $75; and
         (c)   Third offense: Class A infraction, fine of $100.
      (2)   In addition to the applicable fine amount, individuals convicted under § 91.01 of this chapter must pay any and all attorney’s fees and costs of collection.

      (3)   Upon conviction for a violation of § 91.01 of this chapter, the sound device used during the commission of the offense shall be subject to seizure for payment of the judgment. In addition, the town officer may seize the device used to violate any part of § 91.01 of this chapter as evidence for the court when the violation is discovered.

   (C)   Any person violating § 91.02 of this chapter shall be deemed to have committed a Class A infraction and shall, upon conviction thereof, be fined in an amount not to exceed $100, plus any and all attorney’s fees and costs of collection. A separate offense and shall be deemed committed on each date during or on which a violation occurs or continues. Upon conviction for a violation, the sound device used during the commission of the offense shall be subject to seizure for payment of the judgment. In addition, any town officer may seize the device used to violate any part of § 91.02 of this chapter as evidence for the court when the violation is discovered.

   (D)   (1)   It is hereby made the duty of any person, firm or corporation to comply with the terms of § 91.03 of this chapter and any person, firm or corporation violating any of the provisions of § 91.03 of this chapter shall be guilty of a misdemeanor and shall suffer the penalties of § 91.03 of this chapter as hereinafter set out, to-wit: any violation of any provisions of § 91.03 of this chapter shall constitute a Class B infraction and a fine to be levied against such persons, firm or corporation in the amount of not less than $75, plus any and all attorney’s fees and costs of collection for each day of violation.

      (2)   None of the provisions of § 91.03 of this chapter shall effect any pending cause of action or right of action, either civil or penal.

   (E)   Any violation of § 91.04 of this chapter within the same calendar year will be considered a Class C infraction and shall, upon conviction thereof, be fined in an amount not to exceed $50 per violation, plus any and all attorney’s fees and costs of collection.

   (F)   Any person violating the provisions of § 91.06 of this chapter commits a Class C infraction and shall, upon conviction thereof, be fined in an amount not to exceed $50, plus any and all attorney’s fees and costs of collection. Each day that a violation continues shall be deemed a separate offense.

   (G)   Any person violating the provisions of § 91.07 of this chapter commits a Class C infraction and shall, upon conviction thereof, be fined in an amount not to exceed $50, plus any and all attorney’s fees and costs of collection.

   (H)   (1)   Any person violating the provisions of § 91.21 of this chapter commits a Class C infraction and shall, upon conviction thereof, be fined in an amount not to exceed $50, plus any and all attorney’s fees and costs of collection.
      (2)   The applicable fine amount for a first-time offense under § 91.21 of this chapter may be waived by the Department if said violation is remedied within five days of notice thereof, waiver is not available for any subsequent offense thereafter.
      (3)   Each nuisance shall constitute a separate violation and each day that a violation continues shall be deemed a separate offense.
