(A) Registration guidelines.
(1) All pets kept within the City of Tool must be registered with the city, the fee for registration will be $10 per animal and will be valid for a term of one calendar year.
(2) Proof of a current rabies vaccination must be shown at time of registration.
(3) All fees assessed by the city in regard to this chapter must be paid before registration will be issued.
(B) Registration of dangerous or vicious animals.
(1) The owner of an animal declared to be dangerous or vicious under this chapter shall, within ten days of obtaining compliance with the requirements of this chapter, register the animal with the Animal Control Officer or his or her designee. In the event a dangerous or vicious animal is loose, stolen, or unconfined, has attacked another animal, has attacked a person or has died, the owner shall notify the Animal Control Officer or his or her designee of such fact.
(2) An owner of an animal declared to be a dangerous or vicious animal under this chapter must comply with the following requirements within 30 days of such final determination. Compliance with these requirements will be determined by the Animal Control Officer or his or her designee.
(a) The animal must be registered in accordance with this chapter. Photographs of the animal shall be taken and remain on file with the city's Animal Control Officer or his or her designee.
(b) The owner of the animal shall issue letters, via certified mail, to all individuals residing within 200 feet of the animal and show proof of such notifications to the Animal Control Officer or his or her designee.
(c) The animal must be kept in a secure enclosure.
(d) The owner must present to the city Animal Control Officer or his or her designee a certificate of public liability insurance in the amount of $100,000 to cover any damages caused or which may be caused by the animal. The insurance shall be for a 12-month period and shall not be cancelled unless the animal is no longer kept by the owner.
(e) The animal, when taken outside of the enclosure, must be secured and muzzled in a manner that will not cause injury to the animal or interfere with its vision or respiration, but shall prevent it from biting any person or animal, and the animal must be restrained by a substantial chain or leash having a minimum tensile strength of 1,000 pounds and not to exceed six feet in length, and shall be restricted from any public park or area where children under the age of 17 may congregate or gather.
(f) The owner shall post a sign on his or her premises warning that there is a dangerous or vicious animal on the property. The sign shall be visible and capable of being read from the public street or highway.
(g) The animal must be spayed or neutered.
(3) Any owner of an animal declared to be a dangerous or vicious animal that fails to comply with the ownership requirements listed within this division will be in violation of said division. In such an event, the animal in question shall be humanely euthanized by a licensed veterinarian.
(4) Any dangerous or vicious animal that is found to be at large subsequent to the owner thereof having knowledge or notice that such animal is dangerous or vicious may be killed by any law enforcement officer without the officer having to catch and impound such animal or notifying the owner of the animal. Nothing in this division shall impair the ability of any law enforcement officer, Animal Control Officer or his or her designee from securing any such dangerous or vicious animal whose owner has failed to comply with all of the requirements found herein.
