6-1-5: VEHICLE USE ON COAL MINE WASTE PILES:
   A.   Definition: For purposes of this section, "vehicles" are defined as motorized devices utilized for transportation or recreation and include, but are not limited to, automobiles, trucks, SUVs, four (4) wheel drives, go-carts, motorcycles and snowmobiles.
   B.   Vehicle Use Prohibited: No vehicle, as defined in subsection A of this section, may be driven, parked or utilized upon the Toluca Coal Mine waste piles ("jumbos"), except as set forth in subsection C of this section.
   C.   Exemptions: Emergency vehicles and any other vehicles specifically authorized by the city, the city police department or the Toluca Sportsman's Club and/or its lessees shall be allowed to enter and remain upon the Toluca Coal Mine waste piles ("jumbos") within the times and areas specified by the authority granted by the appropriate city/sportsman's club department or individual.
   D.   Penalties: Any person violating this section shall be fined not less than twenty five dollars ($25.00) for the first offense or violation. Any person who shall be adjudged guilty of violating this section a second or subsequent time shall be fined not less than fifty dollars ($50.00) nor more than one hundred dollars ($100.00) for each subsequent offense.
