5-1-3: ANIMAL CONTROL OFFICER; ENFORCEMENT:
   A.   The Chief of Police shall be ex officio animal control officer for the City of Toluca. Provision shall be made for the appointment of such animal control officers as may be necessary. The animal control officers, employed by contractual agreement or otherwise, shall be authorized to investigate matters regarding the provisions of this chapter and issue citations for violations of this chapter. The animal control officer is charged with enforcement of this chapter.
   B.   Any violation of this chapter is hereby declared to be a nuisance. In addition to any other relief provided by this chapter, the City Attorney may apply to a court of competent jurisdiction for an injunction to prohibit the continuation of any violation of the provisions of this chapter. Such application for relief may include seeking a temporary restraining order, temporary injunction, and permanent injunction. A separate offense under this chapter shall be deemed committed on each day during or on which a violation occurs or continues. (Ord. 2007-12-10, 12-10-2007)
   C.   Every owner of any animal residing within the City shall comply with all ordinances of Marshall County with respect to such animal, including without limitation ordinances requiring the registration of animals and regulating the conditions with respect to the ownership of multiple animals. Failure to comply with such ordinances shall be a violation of this subsection C, punishable by a fine not less than fifty dollars ($50.00) and not more than seven hundred fifty dollars ($750.00). Each day that failure to so comply continues shall be considered a separate violation. (Ord. 2017-9-11, 9-12-2017)
