793.20. County Sealer of Weights and Measures to certify out of town scales.
   In the event such weigh-master desires to use any scale not located in the City of Toledo for the purpose herein provided, he or his employer shall first make application to the Chief Inspector of Weights and Measures of the City of Toledo for inspection of such scale, and upon payment of a fee of two dollars and fifty cents ($2.50) to the City by such applicant the Chief Inspector of Weights and Measures shall make inspection thereof, and if such scale is found by him to be correct and according to the standard prescribed by law, shall seal and mark the same with a stamp or by pasting a card thereon as required by Section 787.03. Thereafter so long as such scale is used for such purpose it shall be inspected once a year by such Chief Inspector of Weights and Measures and such inspection fee shall be paid by such applicant for each inspection thereof; provided, however, that if it is finally judicially determined that such Chief Inspector of Weights and Measures is without lawful power and authority to test and certify scales of certified dealers located outside of the borders of the City, then inspection and certification of such scales may be made by the County Sealer of Weights and Measures of the county wherein such scale is situated, and such certification, if made once a year as required herein, shall then be sufficient for the purposes of this chapter.
