As used in this chapter:
(a) "Approved disposal site" means a demolition disposal site as defined by Section 1713.01(d) of the Health Code, and any solid waste disposal facility, licensed pursuant to Ohio R. C. Chapter 3734, except that dirt, rock and concrete may be deposited upon private property with written approval of the owner, and in accordance with applicable local, state and federal law. All such sites shall be managed so as not to create a nuisance.
(b) "Dumping" means the discarding, dropping, placing, throwing, depositing or dispensing of waste.
(c) "Garbage" means any putrescible animal and vegetable material resulting from the handling, preparation, cooking and consumption of food.
(d) "License" means a permit granting authority, pursuant to the Municipal Code, for a person to engage in the business of collecting, hauling or disposing of waste in the City.
(e) "Licensee" means any holder of a license issued pursuant to this chapter. Any violation of this chapter by an agent or employee of the licensee shall be deemed a violation by the licensee.
(f) "Person" means any individual, firm, partnership, association, corporation, company, group of individuals acting for a common purpose or organization of any kind, excepting a governmental agency.
(g) "Refuse" means all putrescible and nonputrescible solid material (except body waste), including, but not limited to, garbage, rubbish, ashes, street cleanings, dead animals, abandoned motor vehicles, used motor vehicle parts, tires, junk as defined in Section 733.01(b), building materials, solid market and industrial wastes, used chemical and oil waste, and any other similar substance, man-made or otherwise, which no longer serves the functional use for which it was intended.
(h) "Rubbish" means all nonputrescible solid material consisting of both combustible and noncombustible matter, including but not limited to, paper, wrappings, cigarettes, cardboard, tin and aluminum cans, yard clippings, leaves, wood, glass, concrete, dirt, plaster, plaster board, roofing material, nails, bedding, crockery and similar material.
(i) "Waste" means all garbage, refuse and rubbish, as defined in this chapter, and any other similar substance, man-made or otherwise, which no longer serves the functional use for which it was intended at the location it is dumped or which may become noxious, offensive, injurious or dangerous to the public health, comfort or safety. Any refuse, rubbish or waste, as defined in this chapter, other than tires, intended to be reused, recycled or reclaimed for a beneficial use at another appropriate location, is excluded from this definition of waste.
