139.01. Department established.
   A Department of Health and Environment is hereby established, pursuant to the authority of Section 102 of the Charter and Ohio R.C. 3709.05, which provides for an administration of public health to be established and maintained under authority of a city charter different from the City Board of Health described therein. The overall functions and duties formerly exercised by the City Board of Health are hereby transferred to the City; and any references in other sections of the Ohio Revised Code or the Toledo Municipal Code to the Health Commissioner shall, unless other provisions are made, be transferred to the Director of Health.
   (a)   All contracts, agreements and obligations entered into by the former City Board of Health shall be assumed by the City effective immediately.
   (b)   All regulations adopted by the Board of Health, codified in all appendices to Part Seventeen of the Toledo Municipal Code are hereby ratified, affirmed and approved until such time as they are modified by the Director of Health and Environment and/or Medical Officer.
   (c)   Toledo Municipal Code Part Seventeen-Health Code, which includes Title One, Three and Five, that is, Toledo Municipal Code Chapters 1701 through 1779 and their respective appendices shall be administered and enforced by the Director of Health and Environment of the City of Toledo. Any reference in Toledo Municipal Code Part Seventeen to "Commissioner of Health" shall be read to mean "Director of Health and Environment and/or Medical Officer" as appropriate under the circumstances. Any reference in Toledo Municipal Code Part Seventeen to "Board of Health" or "Toledo Board of Health" shall be read to mean "City of Toledo Department of Health and Environment and/or Director of Health and Environment" as appropriate under the circumstances.
