WASTEWATER HAULING REGULATIONS
300.01 Registration And Discharge Conditions
   A.   Any Domestic Septage Hauler must be registered with and receive a permit from the Department's Division of Water Reclamation and post a bond. Each truck must display a valid decal issued by the Department on the exterior of each Vehicle and each Vehicle shall carry the permit issued by the Department. This registration must be renewed and a new permit issued each year by the Department. Applications shall be filed no later than January 1st of each year and permits and decals will expire January 1st of each year.
   B.   To apply for a permit or permit renewal, the Domestic Wastewater Hauler shall file a written application with the Department's Division of Water Reclamation with such information as the Division of Water Reclamation may require. In addition, each applicant shall:
      1.   Submit to the Department the Owner's legal address and the legal business address and type of business, i.e. domestic hauler; and
      2.   Submit to the Department the number of trucks, tank capacity in gallons of each truck, and license numbers of all trucks.
   C.   Each Vehicle shall have the ability to allow samples to be taken. Each Vehicle shall have the company's name, address, and capacity in gallons displayed in a conspicuous manner similar to that required by the Ohio State Board of Health.
   D.   Each applicant shall be bonded at a minimum amount of one thousand dollars ($1,000) if a small hauler or five thousand dollars ($5,000) for a large hauler, as determined by the Department, tendered by a company registered in the State of Ohio. The bond shall be posted with the Department's Division of Water Reclamation.
   E.   Each Septic tank cleaning company shall discharge waste only at the Septage discharge building at the Plant. No other location for discharging shall be permitted without the consent of the division head of Water Reclamation or the Shift Supervisor on duty.
   F.   Each Septic tank cleaning company shall not discharge a load until approval of a Shift Supervisor or, in the absence of a Shift Supervisor, the central operations operator, has been obtained.
   G.   Haulers shall purchase Discharge Tickets from the Division prior to discharging waste. All outstanding bills must be brought up to date before tickets will be sold to each company. Books of tickets shall be purchased in advance of discharging, and one ticket will be presented at the Central Operations Station Office before dumping will be permitted. Tickets may be purchased at the Plant. Tickets are specific for the size of the tank. All payments for ticket books shall be by certified check or money order or a good funds check (no cash), made out to the City of Toledo, Department of Public Utilities. The price of the tickets shall be determined using the rate specified by the Director. This rate will be for a per one thousand (1,000) gallon load or less plus an administrative charge per ticket which includes sampling, testing and odor control costs for all acceptable discharges.
   H.   Regular discharging hours shall be Monday through Friday between 7:00 a.m. and 4:00 p.m. The Shift Supervisor has the right to refuse acceptance of any or all Septage waste. The division head of Water Reclamation may suspend acceptance of all Septage waste with due cause. In case of an emergency or weekends, discharging will be permitted only after notification to the Shift Supervisor and permission is granted in advance by telephone (419-729-3861). Requests for scheduled discharge outside these hours must be submitted to the Division of Water Reclamation at least two (2) days in advance of the first proposed discharge date. Permission to discharge on a routing, scheduled basis outside the regular discharge hours will be granted at the discretion of the division head of Water Reclamation.
   I.   Acceptance of liquid waste other than domestic Septage will not be accepted without the written approval of the division head of Water Reclamation. Requests for acceptance of liquid waste other than domestic Septage shall be submitted to the division head of Water Reclamation in writing at least five (5) business days prior to the proposed discharge date. The request for acceptance of liquid waste other than domestic Septage shall include the name and address of the waste generator, a description of the process that produced the waste, and any relevant analytical data for the pollutants listed in these Rules and Regulations. The Division of Water Reclamation may request additional sampling and analysis be done prior to determining if the waste may be accepted for discharge.
   J.   No complete cleanup of the Septage hauling tanks shall be permitted. Tanks may be hosed down only.
   K.   Each Septic tank cleaning company shall abide by rules concerning cleanliness of the Septic Discharge Building.
      1.   Floors, walls, etc., shall be kept clean and hosed down after each discharge.
      2.   All drivers shall be responsible for washing down the area after discharging. Water and hoses will be made available.
      3.   The central operations operator will operate the Septic odor control system located in the Septic discharge building when a Septic hauler is discharging from May 15th through November 1st.
      4.   The building will be inspected after each discharge and violators will be subject to these Rules and Regulations.
   L.   Each applicant shall have the following comprehensive automobile liability:
      1.   Bodily injury and property damage combined one million dollars ($1,000,000) each occurrence and one million dollars ($1,000,000) aggregate.
      2.   This insurance shall include for bodily injury and property damage the following coverage: (a) owned automobiles; (b) hired automobiles; (c) non-owned automobiles.
      3.   An umbrella policy may be used to satisfy the insurance limits indicated.
300.02 Discharging Procedures
   A.   Go to Central Operations Building to make log book entries, submit ticket.
   B.   Complete logbook columns 1-8.
   C.   Submit a completed CITY OF TOLEDO LIQUID SEPTIC HAULERS MANIFEST to the Plant operator.
   D.   The Plant operator will unlock the Septage discharge station and operate the odor control system as required.
   E.   Unload the waste in a proper manner.
   F.   Clean the building, pull hoses off to the side, and turn the water off.
   G.   Return to the Central Operations Building when finished discharging and initial column 8 in the log book to indicate that you have cleaned the Septic Discharge Building. See that the operator initials column 9 to acknowledge that the building was cleaned and locked.
300.03 Prohibited Discharges
   A.   The contents of all Domestic Wastewater Haulers Vehicles discharging at the Septic Disposal Building at the Plant are subject to sampling and testing by the Department. The sampling and testing taken by the Department under these Rules and Regulations shall test for compliance under TMC § 930.01 and the discharger shall not exceed either the current Pollutant Limits of Code of Federal Regulations 40 CFR Part 503 Subpart 503 Part 503.13 Table 3, or the following metal concentration standards:

Any Domestic Wastewater Haulers' contents that exceed the maximum metal concentrations or are subject to TMC § 930.04(b) will be subject to enforcement proceedings as specified in these Rules and Regulations.
   B.   The Shift Supervisor may refuse to accept any wastewater if he deems it unsatisfactory for discharge at the Plant.
300.04 Administration Procedures
   All Domestic Wastewater Haulers shall maintain accurate monthly business records, available to the Division of Water Reclamation upon request, showing names, addresses, and telephone numbers of the generators of all wastewater being transported and/or disposed, the volume of waste, and the disposal site.
300.05 Penalties For Violation Of Above Conditions And Procedures
   A.   The penalties for the discharging of illegal or unacceptable waste include, without limitation, all or some or a combination of the following:
      1.   Forfeiture of bond. A new bond shall be posted before any additional discharging will be permitted.
      2.   Indefinite suspension of discharge privileges. Suspension to be reviewed by the Division of Water Reclamation to determine length and degree.
      3.   Reimbursement for additional treatment costs, expenses or damages incurred due to the illegal or unacceptable discharge.
   B.   The penalties for the discharging of waste at an unapproved location include, without limitation, all or some or a combination of the following:
      1.   Forfeiture of bond.
      2.   Discharges shall be subject to penalties described in TMC § 945.99 and shall be prosecuted to the fullest extent of the law.
   C.   The penalties for violation of cleanliness rules of building include, without limitation, all or some or a combination of the following:
      1.   First violation: Written warning. If no violation occurs within one (1) year period, the company's violation record shall be cleared.
      2.   Second violation (within one (1) year of first violation): Ten (10) day suspension. If no violation occurs within one (1) year period, the company's violation record shall be cleared.
      3.   Third violation (Within one (1) year of first violation) : One (1) year suspension.
   D.   Failure to have a Septage Discharge Ticket or attempting to use a Septage Discharge Ticket for a Septage load volume that is less than the Septage volume to be discharged shall result in refusal to allow discharge of Septage.
   E.   Discharging at the Septage discharge building without presentation of a proper Septage Discharge Ticket shall be subject to penalties described in TMC § 945.99 and may be prosecuted to the fullest extent of the law.
