If at any time the Board of Review determines that the public convenience and necessity require the operation of one (1) or more escrowed permits, it shall order the resumption of operation of a sufficient number of permits to satisfy such public convenience and necessity. The order to resume operations shall apply to the escrowed permits within the particular type of permit in the order in which the applications for escrow were granted, that is, the permit first suspended shall be the first as to which the order to resume is made. The order to resume operation of a permit may be served personally or by mail to the permittee at his address as filed with the Director. If a permittee fails for a period of forty-five (45) days to resume operation after resumption has been ordered by the Board of Review, the permit or permits affected by the order shall be revoked.
