As used in this chapter, the following words shall have the following respective meanings:
(a) "Person" means an individual, partnership, corporation, firm or other entity, by whatever name designated.
(b) "Scrap" means any personal property which is or may be salvaged for re-use, resale, reduction or similar disposition, or which is possessed, transported, owned, collected, accumulated, dismantled or assorted for any of the aforesaid purposes. Used household furniture, used wearing apparel, used lumber, used brick, used tile, used plumbing fixtures, used electrical fixtures, used articles made of precious metal or metals, used jewelry, used tools and other used articles or personal property, which are bought and sold as second-hand property, and which are not handled as what is ordinarily called "scrap" or salvaged material, shall not be included in the term "scrap" as used herein. Without limiting the aforesaid definition of "scrap", the term includes used or salvaged iron, brass, lead, copper and other base metal or metals, and their compounds or combinations; used or salvaged rope, bags, paper, rags, glass, rubber and similar articles, or property, and used motor vehicles which are used, owned or possessed for the purpose of wrecking or salvaging parts therefrom.
(c) "Scrap dealer" or "scrap metal dealer" means every person who buys, exchanges, collects, receives, stores or sells any article or articles as defined herein.
(d) "Scrap yard", "junk shop" or "scrap processing yard" means any place at which a junk or scrap dealer buys, exchanges, collects, receives, stores, accumulates, sells or otherwise handles junk.
(e) "Personal identification card" means a current and valid driver's license, military identification card, state identification card issued under sections 4507.50 to 4507.52 of the Ohio Revised Code, or a state identification card issued by another state on the condition that that card contains information substantially similar to the information contained on a state identification card issued under sections 4507.50 to 4507.52 of the Revised Code and also contains a photograph of the person to whom the card is issued.
(f) "Restricted article" means all of the following:
(1) Beer kegs;
(2) Cable, wire, electrical components, and other equipment used in providing cable service or any utility service, including, but not limited to, copper or aluminum coverings, housings, or enclosures related thereto:
(3) Grave markers, sculptures, plaques, and vases made out of metal, the appearance of which suggest that the articles have been obtained from a cemetery;
(4) Guard rails for bridges, highways, and roads; highway and street signs; street light poles and fixtures; manhole covers, water meter covers, and other similar types of utility access covers; traffic directional and control signs and light signals, metal marked with the name of a political subdivision of the state, and other metal articles that are purchased and installed for use upon authorization of the state or any political subdivision of the state;
(5) Historical, commemorative, and memorial markers and plaques made out of metal;
(6) Four-wheel metal carts, commonly referred to as "grocery carts," that are generally used by individuals to collect and transport consumer goods while shopping;
(7) Four-wheel metal carts, commonly referred to as "metal bossies," that are used to transport or merchandise food products that are stored in crates, shells, or trays;
(8) Water meters and backflow preventer units, or similar valve devices;
(9) Titanium, carbide, and other tools and implements used in the machining industry;
(10) Construction, industrial and agricultural equipment;
(11) Any metal identified or marked with a neon yellow and/or green color;
(12) Catalytic converters in whole or part; and or any of its individual component parts and or any of its contents. Individual components and contents include but are not restricted to any materials from decanning of a catalytic converter or any other process that separates the individual component parts of a catalytic converter. "Decanning" is the removal of the auto catalyst materials from the whole steel converter unit. This involves shearing open the steel or stainless steel case to release the bead or honeycomb ceramic biscuits.

(g) "Recyclable materials" means the metal materials described in division B(1)(f) of this section, on the condition that those metal materials are not restricted articles.
(h) "Motor vehicle" has the same meaning as in Section 4501.01 of the Ohio Revised Code.
(i) "Retail transaction" means any transaction involving any person other than an industrial or commercial account, a nonprofit account, or a governmental account, in which a scrap metal facility purchases or receives scrap metal.
(j) "Industrial or commercial account" means any person, operating from a fixed location, that sells scrap metal to a scrap metal facility pursuant to a written agreement or written account certification and who has sold more than $10,000 of scrap to the scrap metal facility during the previous 12 months with payment by check payable to the company in the company name. The term may include other scrap metal facilities.
(k) "Nonprofit account" means any nonprofit organization that is exempt from federal income taxation under subsection 501(a) of the Internal Revenue Code, 26 U.S.C.A. 501(a), and that sells scrap metal to a scrap metal facility pursuant to a written agreement or written account certification.
(l) "Governmental account" means any political subdivision, as defined in Section 2744.01(F) of the Ohio Revised Code, that sells scrap metal to a scrap metal facility pursuant to a written agreement or written account certification.
