The incorporation of sections of the Ohio Administrative Code into this chapter of the Toledo Municipal Code is subject to the following amendments:
(a) References to the "Ohio Environmental Protection Agency" have been changed to the "Toledo Pollution Control Division";
(b) References to the "Director of the Ohio Environmental Protection Agency" have been changed to the "Commissioner of the Toledo Pollution Control Division";
(c) References to industries not found within the jurisdiction of the Toledo Pollution Control Division should be considered deleted;
(d) References to areas outside the jurisdiction of the Toledo Pollution Control Division should be considered deleted;
(e) References to other sections of the Ohio Administrative Code should be considered to be references to the corresponding sections of the Toledo Municipal Code;
(f) O.A.C. 3745-21-08(A) revise to read as follows:
"(A) This rule is applicable to all stationary sources located within the City of Toledo."
(g) O.A.C. 3745-21-09(A)(1) revise to read as follows:
"(1) In the City of Toledo, the requirements of paragraphs (C) to (M), (R), (T), (U), (V), and (W) to (EE) shall apply to all sources regardless of date of construction or modifications.";
(h) O.A.C. 3745-21-09(B) revise to read as follows:
(B) General Provisions.
(1) Compliance with the limitations specified in paragraphs (C) to (K), (T), and (X) of this rule is based upon a weighted average by volume of all coating materials employed in the coating line or printing line in any one day. The volatile organic compound contents and densities of the coating materials subject to paragraphs (C) to (K), (T), and (X) of this rule shall be determined in accordance with paragraph (B) of O.A.C. 3745-21-10. The VOC emission rate, capture efficiency and control efficiency for coating lines or printing lines subject to paragraphs (C) to (K), (T), and (X) of this rule shall be determined in accordance with paragraph (C) of O.A.C. 3745-21-10. The averaging of VOC emissions over two or more coating lines and/or printing lines in order to demonstrate compliance with an applicable emission limitation (i.e., cross-line averaging) is prohibited except as otherwise provided in this rule. Except as otherwise provided by this rule, the owner or operator of any coating line or printing line subject to this rule shall maintain records which document current compliance with the emission limitations, control requirements, and exemption provisions contained in this rule. The U.S. Environmental Protection Agency publication entitled "Recordkeeping Guidance Document for Surface Coating Operations and the Graphics Arts Industry" (EPA 340/1-88-003, July 1989), and any subsequent revisions thereof, will be used by the Ohio EPA in determining the adequacy of the records kept pursuant to this rule.
(2) Any approval granted by the Commissioner in accordance with paragraphs (I)(2), (K)(3), (L)(1)(a)(ii), (O)(2)(c)(iii), (O)(3)(c)(v), (O)(4)(a)(iii), (S)(4), (T)(1)(b)(iii)(c), (BB)(3)(e), (BB)(16), and (BB)(17)(b)(iii) of this rule shall be submitted to the U.S. Environmental Protection Agency to be approved as a revision of the state implementation plan.
