Toledo Public Power shall have and may exercise any and all legal powers and duties granted to municipal electric utility systems by the constitution, laws and regulations of the State of Ohio and the charter and municipal code of the City of Toledo including, but not limited to, the following:
(a) Acquire, construct, own, lease and operate a municipal electric utility and contract with others for any such product or service.
(b) Contract with appropriate third parties in connection with all aspects of the establishment, operation and maintenance of a municipal electric utility.
(c) Supervise the work of all consultants or contractors engaged by the City of Toledo in connection with the establishment of a municipal electric utility and its power program.
(d) Enter into contracts or other arrangements relating to the establishment and operation of a municipal electric utility and its power program and supervise the implementation thereof.
(e) Develop plans and procedures for the operation and maintenance of a municipal electric utility and its power program and supervise the implementation thereof.
(f) Acquire and/or lease property for municipal purposes as permitted by the constitution, laws and regulations of the State of Ohio and the charter and municipal code of the City of Toledo.
(g) Establish rates, subject to approval by City Council, for the use of electric service provided by a municipal electric utility and establish billing and collection procedures.
(h) Purchase, generate, transmit, distribute, aggregate and sell electric power and energy to and from its customers or third parties.
(i) Enter into contracts with other municipal utilities, regulated utilities, independent power producers, governmental aggregators and other appropriate third parties for power, transmission service and operation and maintenance services.
(j) Enter into contracts to create, utilize or sell alternative or renewable power supplies and related green energy credits.
If any of the powers or provisions provided for in this section are held invalid for any reason, the remaining powers and provisions shall remain in effect to the extent they are not dependent on and inseparable from the invalid power or provision.
