Any right that the City possessed prior to the valid enactment of R.C. Chapter 4939 to install and maintain, free of charge, upon any poles and within any underground pipes and conduits or other facilities of any holder of a general or special right of way permit, any facilities desired by the City shall continue in effect unless extinguished by a court of competent jurisdiction. Each permit holder subject to said right shall cooperate with the City in planning and designing its facilities so as to accommodate the City's reasonably disclosed requirements in this regard.
