(A) The Emergency Planning Commission has been established pursuant to I.C. 13-25-1-6. Under the terms of I.C. 13-25-1-6(h), the Emergency Planning Commission is a county board and subject to the rules governing county boards.
(B) The Emergency Planning Commission shall be composed of the members appointed by the Indiana Emergency Response Commission as set forth in I.C. 13-25-1-1.
(C) The Emergency Planning Commission shall have the rights and obligations imposed under I.C. 13-25 including, without limitation:
(1) The duty to prepare or review and update a local emergency plan;
(2) The duty to submit a spending plan to the Council; and
(3) The duty to make available to the public the materials specified under I.C. 13-25-2-14.
